Joe Biden is actually doing an exceptional job getting legislation through congress. I get you don’t like any of it but pound for pound he is up there.
Look I’m not exactly on board with the student loan stuff, as I’ve stated I’d prefer a different approach, but legally it’s probably good. The Heroes act is pretty clear and it’s not even his emergency order he is working off of.
I assume you’re arguing there is no such emergency because US deaths and hospitalizations have become manageable. That doesn’t mean the impact of the pandemic has subsided. Obviously we are under great global economic pressure from Covid and the economic well being of the country isn’t stable. Everything from housing to child rearing has been negatively impacted. And that was the point of the provision in the act - to be able to give relief to some groups impacted by these large scale events.
As to executive orders directing congressionally appropriated spending. Depending on the wording of the legislation, the president does have great latitude as long as they stay within the scope of the appropriation. Sometimes congress is very specific in their appropriation and sometimes very broad. They do this on purpose to steer the president or give him discretion. We’ve already been through this with DACA which has been upheld.
As to Biden having some insulation from the courts and congress and this no pressure. All of that will change. Trump was just unable to manage his own party when he had total control of government is the difference between him and Biden.
