Did anybody else switch to the mainstream Republicans after seeing the Marines standing behind Biden at the national unity speech last night? I didn't know so many U.S. Marines were blue no matter who. I mean, i can understand the FBI, how it ends up 99% donkeys, but i had no idea the U.S. Marines were backing Biden too. So, sorry guys, i'm out. I have no way of keeping the Marines out of my house, warrant or not. I don't have any F-15'a in my driveway. Lynsey Graham good. Tucker bad. Putin bad. Ukraine good. 2020 election not stolen through massive fraud. Marry whoever you want. Use birth control ok. Watching my manners. On the other hand i didn't see the U.S. Marines move, like at all, so i'm not sure if they were props or not...but i'm not taking any chances.

Let's start at the beginning for you. There are three branches of government. The Executive, the Legislative, and the Judicial. As long as each branch of government operates withing its constitutional scope, it matters not whether the Legislature enacts more or less laws from one year to the next or whether a court decides more or fewer cases than another court or its predecessor.

Ditto for the Executive Branch. The President has the power to issue Executive orders in any number he wishes. Whether it is more or less than the previous president is irrelevant.

Alright, now that I have brought you up to speed, let's proceed from there.

The problem sets in when a Judge issues a court decision which is actually within the jurisdiction of the Legislative Branch. Or when a President uses an executive order to supplant the power of the Legislature. The number of properly issued executive orders by a president is neither here nor there. It is the unconstitutional ones that are problematic.

Refer to Obama's/Biden's use of Executive Order to supplant/circumvent existing immigration legislation, and Biden's use of executive order to nullify the power of Congress to exercise its powers in this area.

But yes your argument is still weak. Trump had 70 executive orders overturned that included everything from misappropriation of military funding to religious travel bans.

I think Trump ended out with like 40 injunctions etc in total on his various orders.

It is important to note Trump relied so heavily on executive orders because he could not get his agenda passed through congress, even with republicans having total control of the government for 2 years. He was an exceptionally poor performing president from the perspective of getting his agenda into law.

It depends. A lot of this stuff is subjective. Tree isn’t going to like executive orders from any democrat president because of his ideology- or total lack thereof.

Our only measure is how these matters hold up through the judicial review process. And, to be fair, even then they’re not technically overturned until the Supreme Court overturns them. Even though if an injunction is applied and stays standing for all intents and purposes that order has been nullified.

Joe Biden is actually doing an exceptional job getting legislation through congress. I get you don’t like any of it but pound for pound he is up there.

Look I’m not exactly on board with the student loan stuff, as I’ve stated I’d prefer a different approach, but legally it’s probably good. The Heroes act is pretty clear and it’s not even his emergency order he is working off of.

I assume you’re arguing there is no such emergency because US deaths and hospitalizations have become manageable. That doesn’t mean the impact of the pandemic has subsided. Obviously we are under great global economic pressure from Covid and the economic well being of the country isn’t stable. Everything from housing to child rearing has been negatively impacted. And that was the point of the provision in the act - to be able to give relief to some groups impacted by these large scale events.

As to executive orders directing congressionally appropriated spending. Depending on the wording of the legislation, the president does have great latitude as long as they stay within the scope of the appropriation. Sometimes congress is very specific in their appropriation and sometimes very broad. They do this on purpose to steer the president or give him discretion. We’ve already been through this with DACA which has been upheld.

As to Biden having some insulation from the courts and congress and this no pressure. All of that will change. Trump was just unable to manage his own party when he had total control of government is the difference between him and Biden.
