I am saying that the best and proper reading is that penalties for not standing are not delineated.

there is a big difference between your statement and what is not written.

and will I do not want to attempt to give you a dissertation on employment law... I did do some of it when I was younger and in the past few years I have reviewed multiple employment contracts for doctors.

I suspect I know why the manual is written the way it is.

2. Under the law, its pretty clear employers can compel an employees attendance.
The line is not as clear when it comes to what you can or can not compel an employee to do on the job if he or she does not wish to do it.

At some point 13th amendment arguments come into play. So what happens in the workforce is a company asks an employee to do things a certain way. If the employer is not happy with the way the employee carries out his job... it can fire him or her.

Employers put things in manuals as suggestions. Instead of getting into lawsuits about what you can and can not force and employee to do... you just terminate the employee. When terminating an employee especially in an at will state... the main thing a company does is makes sure its not terminating an employee on grounds which could infringe on that employees civil rights.

So... you can see the NFL manual is very cleverly written.

It compels the players attendance (which is clearly and employers right) and it suggests he should stand so as not to piss off the customer. In a sense taking it out of the civil rights context and into the customer service arena.
