Stand your ground?

If he ran away after pushing me down, i still would have shot him. Think of it as a world favor. I've come across A hole's like this more than once. They deserve to be capped!

So while there are quite unreasonable left wingers in the world, there are regular contributing right wing nutters on this very board. :)

Death penalty for handicap space parking, while black (if you are lucky and you get him angry).

It is clear to me that the white guy was emboldened to take on the black guy because he knew had a concealed gun. As a big guy, I have to be wary sometimes of guys with chips on their shoulders. I seem to be a little too big to catch a lot of this, I know a guy who is smaller, 6'4" and I've seen him bottled twice in one night :confused:

Because guns are comparatively cheap I think it causes a perception that training has to be proportionally cheap also.

When one looks at how careful the modern army is with recruits ensuring they have qualified and are mentally fit (fear of suicide, shootings, accidents) vs a guy like the shooter in this case with what, an NRA joke course for a few hours?

I would hope not because you would be guilty of murder. Listen, I'm all for the right to defend yourself. Was the guy doing the pushing guilty of assault? Yes he was. Should he have parked in that handicap spot? No. Did he deserve a ticket for doing so? Yes.
Did the shooter have a right to pull a weapon in self defense given the situation? Yes, I think so, but in my judgment, looking at the video, the threat to him was not there as soon as his assailant saw the gun. Yes, it was only 4-5 seconds, but that's just the type of situation which requires training so that one can de-escalate, get back on his feet and tell the assailant to back off. He obviously had the upper hand when he pulled the gun as evidenced by the assailant backing off immediately. Lastly, if we're going to allow people to gun down each other simply because they're assholes...invest in body bags. One walk through the Mall or Wal-Mart is all I need to conclude that we most certainly would not be safer if everyone carried a gun.
 
I didn't watch the video. I don't want to see it. I don't understand one thing though. As I understood stand your ground, it means that if you are threatened, you are not required to retreat before using deadly force. Some courts had imposed a duty of retreat on those who used deadly force. The reasoning was that if we can save a life simply by safely retreating, then we're going to expect that sacrifice from you. I don't think it was a good policy because it invited second guessing of life and death situations that often occurred in chaotic situations or without warning. I fail to see how stand your ground applies however if the assailant has himself retreated and no longer poses a threat. There may be a valid question in this case if the victim had in fact retreated. Maybe he was going back to his car to retrieve his own weapon.

I say again, Lyle is an obvious idiot, KKK is such a fragile thing he can't look at a shooting video..(really?).. There are a LOT of right wingers here who are not "within the bookends" of normal men (paraphrasing the cop)

Well, of course, there is the law and then there is the magic that gets worked at trial too. You have to get an indictment and a conviction.

The Trevon Martin case is relevant of course because it also was governed by Florida law. Martin not only retreated but he ran down the street, and Zimmerman shot and killed him when they got into an altercation there. And he was acquitted at trial.

Those who are aghast at the stand your ground states need to also keep in mind that some states- Texas being one of them- do not even require stand your ground. It is still legal to shoot a felon committing a property crime and other fleeing felons and it is done rather regularly and quite a few of the Texans own guns and know how to shoot and know what the law is.

Take the infamous Joe Horn here- below- in Texas who shot and killed some burglars or at least one of them breaking into his neighbors home ACROSS THE STREET. The outcome for Joe? He skated completely. The prosecutor put it before the grand jury and the grand jury would not even indict to send it to trial.

It was not a matter of jury nullification either- for those of you who know what that is- he just did not break any law in Texas. Whether it should or should not be that way and how one feels about it is neither here nor there in court.

Based on your logic. I can walk right up to you and hit you with heel of my hand, right on your nose and send it into your skull and run away. You can't retaliate because of the law, I'm running away and no longer a threat.
