Stand your ground?

Was this guy justified in shooting the man based on stand your ground laws? IMO, no. Doing some investigation it's obvious this guy was looking to provoke an incident just so he could shoot someone. Also obviously mentally disturbed.

 
Shooter not arrested because stand your ground law as written prevents it. There are some people protesting this because the shooter was white and the victim black. frankly, I think they have a case in this situation. If the shooter was black and the victim white the usual suspects would be bitching up a storm about political correctness preventing an arrest. The most elementary investigation is showing that this guy was going around trying to provoke people into violent acts. That alone is enough to justify an arrest.

Was he in reasonable fear of further bodily harm? No, the reaction to him producing the gun was clear, he had no justification in firing without the guy moving towards him again.

Only a second between justified and not imo.At first I thought he was but after watching 3 times I say he was not.If he had pulled his gun and fired as soon as he hit the ground I would say justified.He waited until the guy started to retreat to fire so its unjustified imo but with such a split second decision after being assaulted and seeing that the assulter and 2 his friends were about to attack if I were on a jury I would say not guilty.

I only read his wife in the car had just finished her shift as a nurse and they have a bunch of kids under six with them.

I could be mistaken and probably was about the 2 friends.I didnt read anything I just watched shooting part of the video but after the guy was pushed to the ground it looks like the 2 other people in the video was approaching him too.looking into the mind of the shooter he gets pushed down hard looks up and sees the guy who pushed him and 1 or 2 others approaching him I not sure he wasn't really scared for his safety.

In the longer clip online you see a couple of unrelated people, man and woman entering the store. They clearly stopped and noticed him being difficult, it would be worth knowing what was being said really in this case. Seems like the guy was verbally attacking the man's wife in front of his family?

I've been in a couple of legal situations when I stood my ground outside of my job as a park ranger were I had some modicum of legal protection. These were guys coming at me in town on instructions from a local boss involved in poaching. A few weeks apart, same plan to get me dead (small chance) or fired by the gang boss. It was expensive and time consuming in legal fees despite the police being sympathetic to me. I get why cops want something more clear and fair but.. I'd have issues with the department on this.

However.. with a gun comes the responsibility to be able to use it... a split second it the difference between going to the work/supermarket and having a car crash as a driver, sometimes several times a day.

We expect people to be competent to use a car.. but not guns so much? And then paper over this deficiency..

Possibly there is a civil counter-suit to play out here.

I didn't watch the video because I have no interest in seeing a tragedy, regardless of where the chips fall. But I will say that I think stand your ground laws were written by idiots for idiots.

A while back I thought they made sense until I realized self defense law pretty much covers you and stand your ground just attempts to protect you from a bruised ego.

Anyone that's avoided a fight knows feeling like a pussy for not escalating sticks with you, even if it's the rational thing to do.
