If I walk into a liquor store and the proprietor knows I am going to walk around the corner and sell the booze to a teenager... he won't sell it. Why? Because he knows what it is going to be used for. The key here is "the knowledge of the fact" for intended use. In this case... the bakers knowledge prohibited him from violating his religion.

Had this lady not told him what it was for, assuming she didn't want "Happy anniversary of he-she-ism" scrolled across the top... I'm sure he would gladly make a pink cake. She should keep her mouth shut.

That's not a blanket coverage or automatic override of Constitutional law.

Phillips is not denying service, he sells cakes to everyone, the person could have purchased any cake off the shelf. The argument is Phillips can not be forced to break his strong held religious beliefs, in this context forced to use his talents to create something as an artistic expression that violates his religious beliefs.

Again SCOTUS has all ready ruled on this.

They ruled on expression grounds not religious, so nice try.

It's a shaky defense, and we'll see what happens when corporations refuse to service religious folk on grounds that their service/craft is an expression of their "art".

Eh, all religion is silly, but people have a right to hold silly beliefs. I'm really not a fan of people parcing the law into these insignificancies; using that logic renders law extremely rigid or ineffective and just ends up dividing people. The law needs some gray area.
