And if he knows what the cake is being made for... and it violates his religion... game over. The color of the cake means nothing. It could have been made in the likeness of a US flag.... he knew what it was for and refused.
If I walk into a liquor store and the proprietor knows I am going to walk around the corner and sell the booze to a teenager... he won't sell it. Why? Because he knows what it is going to be used for. The key here is "the knowledge of the fact" for intended use. In this case... the bakers knowledge prohibited him from violating his religion.
Had this lady not told him what it was for, assuming she didn't want "Happy anniversary of he-she-ism" scrolled across the top... I'm sure he would gladly make a pink cake. She should keep her mouth shut.
