Obviously, this is a clever political play to try to embarrass loudmouth republicans who criticized Trump's proposal. Considering how stupid and cowardly most of the republicans are, they will probably fall all over themselves voting for this.

I was surprised to hear Judge Napolitano say the Constitution applies to "any persons", not just citizens. Bush argued against that. And I think the Courts sided with him....
Either way, its workable. Outside US Jurisdiction, Constitution doesn't apply. Also, substitute the religious test for a national citizenship test (terror states). ICE in Saudi Arabia asking non-citizens if they're Muslim before they board a US-bound flight. Thats doable.
