recklessness can involve conduct which does not require intent.
Some national security laws are purposely written to remove the need for a prosecutor to show intent.

As a non lawyer, non criminal there is no reason for you to understand those differences.

But if you are going to engage in discussion regarding criminal statutes and matters of jurisprudence.

comey crated an intent standard which the laws themselves did not have.
his findings turned over to zealous prosecutor like Mueller would be more than enough to lock her up for a long time.

That investigation needs to be re-opened.

The fbi is under no obligation to keep any investigation closed. Trump has all of his people in there now and I am sure that reviewing them was among first things done.

Correct on all counts.

The espionage act states that it shall be gross negligence and a crime to remove secure documents from their normal place of safekeeping. No intent whatsoever required. Comey changed his assessment of gross negligence to "excessive carelessness" to avoid language that appears in the statute and describes a crime. In fact though, the very definition of gross negligence is excessive carelessness.

As you have stated a couple times and as is lost on the casual understanders, intent is not required in many crimes if it is not specified as an element in the statute making the behavior a crime. If you are totally drunk driving and kill someone it is negligent homicide. If you did not intend to kill someone will get you nothing in court. Just driving drunk even if no accident or damage occurs is a crime as well, as the law has decided that just to create that level of risk for the public or security and safety is a crime in and of itself. So it is for putting secure records at risk.

Hillary was an idiot. She should have pled to some charge that just involved a fine as patreaus did and capped the whole thing off. The next day she could have gone out and beat her chest and claimed that this is what they do to women who try to break the highest and last ceiling blah, blah, blah but that was going to take the hit for the team in order to not jeopardize the future for all women that her candidacy represents. BLAH, BLAH, BLAH. Her base would have eaten right up and others would have been astounded at the sight of her taking responsibility for something for once in her life. But no. It is not her way. Hillary never did anything wrong any time or any where.

Hillary was bound by a memorandum of understanding/agreement rather than a requirement of u.s. law. She did not have to sign it if she did not want to be Secretary of State but it was her way and the governments way to overcome perceived or actual conflicts of interest where her husband and her foundation were receiving foreign donations. And it enabled her to get through senate confirmations knowing that it would be a major source of questioning and a hurdle if she had no plan to address it. Naturally- as is her way- she just totally ignored it once she was confirmed. A lot of the interaction between the foundation and the state department would have been covered in the missing 35,000 emails. That's why she moved immediately to delete and bleach bit them within a few days of being ordered to preserve them.
