Presidents have immunity from criminal prosecution for official or unofficial acts during their presidency that they have not been impeached and convicted for. In this case, it's clear to even the folks bringing the charges, that Trump has done nothing illegal. And when there is a Senate trial that has resulted in acquittal, there can be no charges later.

This question would be tied up for months and perhaps years while winding it's way through the courts. I can tell you right now however that it is illegal and unconstitutional to try an ex-president in The Senate.

A further point is that it's entirely possible that Trump's appeals to SCOTUS could be rejected given that the current make up of SCOTUS is 6 Liberals and 3 Conservatives.

Even though it was unconstitutional, he was acquitted in The Senate. Presidents must have immunity for official and unofficial acts during their presidency otherwise they will be forever concerned about retribution and this will affect their ability to govern effectively. This is includes presidents from all parties. Had Trump done something illegal, I would be the first one to say he should have been impeached, convicted and prosecuted.
 
Everyone, and I mean everyone, understands that these charges are being leveled simply to keep Trump from being president again and further exposing and debilitating The Deep State.
