The president is a different story. The avenue for convicting a president is impeachment and conviction. If Trump was convicted in the impeachment trial, then yes certainly he could be charged later. If SCOTUS allows this to stand, no president will be able to effectively govern going forward and this is likely what the radicals want. One caveat---the judicial system has been overrun by Leftist Marxists, so perhaps a Democrat president could govern the US into oblivion like Obama/Biden is doing now.----Reminder----Trump was not convicted in his "insurrection" trial in The Senate.
Correct, but he is immune from criminal prosection for official and unofficial acts during his presidency. Otherwise, you would be able to prosecute an ex president for say, killing Qasem Soleimani and presidents would be thinking twice about what they do during their term and not conducting affairs in the best interests of the country which Trump did.If a president is indicted and covicted of a felony charge..he has no immunity from prosecution when he is no longer in office.
