US sues Texas to block state troopers from stopping migrants
EL PASO, Texas (AP) — The Biden administration sued Texas on Friday to prevent state troopers from stopping vehicles carrying migrants on grounds that they may spread COVID-19, warning that the practice would exacerbate problems amid high levels of crossings on the state’s border with Mexico.
The Justice Department asked for an immediate block on Gov. Greg Abbott’s order issued Wednesday, which allows the Texas Department of Public Safety to “stop any vehicle upon reasonable suspicion” that it transports migrants. Troopers could then reroute vehicles back to their point of origin or impound them.
The lawsuit, filed in federal court in El Paso, mirrors a letter that Attorney General Merrick Garland sent the governor a day earlier, arguing that the state was usurping and even interfering with the federal government’s responsibility to enforce immigration laws.
Abbott, a Republican who is facing reelection next year, wrote Garland on Friday to argue that the federal government was interfering with his obligations to protect Texas residents.
”It is clear from the arguments in your letter that the State of Texas and the federal government face a constitutional crisis,” Abbott wrote.
The lawsuit escalates tensions between the Biden administration and Abbott over the governor’s actions on the border, which have included jailing migrants on state crimes and building new barriers.
For months, the two-term governor has sought to claim former President Donald Trump’s hardline mantle on immigration, inflaming passions on a polarizing issue. Civil rights groups and immigration advocates have said Abbott’s move for troopers stop vehicles could invite racial profiling and restrict the ability of shelters to take in newly arriving families.
Declarations submitted with the lawsuit offered fresh evidence of large numbers of migrants showing up at the border with Mexico, with senior officials warning that the governor’s order could significantly impede transportation and other federal operations.
The Border Patrol’s Rio Grande Valley sector, the busiest corridor for illegal crossings, had more than 8,300 migrants in custody Wednesday, with an average processing time of 57 hours, said Brian Hastings, the sector chief. The sector has released more than 100,000 migrants since Oct. 1, including 9,000 in the last week.
The Homeland Security Department reported that 646 children traveling alone were taken into custody across the Mexico border on Thursday, compared with a daily average of 480 over the previous 30 days.

And thousands of the 210K will be Covid positive. We also know that for every illegal detained at the border nearly 4 get in unchecked. That means better than 800K illegal aliens entering the country in one month and this had been going on since January. Millions of people, tens of thousands Covid positive, yet you're the guy claiming this horde of illegal aliens have nothing to do with the spike in cases. They have everything to do with the spike. They are the primary driver and anyone with a shred of intellectual honesty knows it. The open border Biden policy is killing untold American citizens, damaging Main street economy, and threatening us with another shutdown this winter.
Are you saying illegals are pouring over the border into Florida and NY and causing spikes there? Before you say anyone with a shred of intellectual honesty knows it, you might want to provide actual facts because to be 100% honest your comments are your opinion that illegals pouring over the border are responsible for 100% of the spike in cases in the entire U.S. Do illegals cross the border at laredo and magically appear in Florida? what about spikes up in the midwest?
You are telling me lack of vaccinations, social distancing and masks have ZERO to do with case spikes in the summer when more people are on top of each other? 100% of it is illegals smuggling in COVID?
You have to admit that it is an absurd proposition to insist on vaccination, masking, social isolation and lockdowns for residents while thousands upon thousands cross the southern border without being tested, without wearing masks and with unknown vaccination status.
The US government has ZERO medical credibility while that situation exists. At this point the CDC is harming people and I stopped paying any attention to them months ago.
And yet 85% of those apprehended crossing the southern border over the past months are sent back by the CBP.
These attempts to blame COVID in the U.S. on illegal immigrants is laughable. And it harks back to the old days in the U.S. where they attempted to slime every immigrant group from the Irish to Chinese to others as "dirty, filthy, disease-spreading vermin". Sad that we are back to this nonsense.
There are plenty of reasons to demand better border enforcement including drugs, guns (mainly going south), money, and human smuggling. The claims about immigrants bringing in COVID are not anywhere up on the list. Especially since there is little evidence that the Mexican or Latin American strains are being spread in the U.S.
No, I'm not saying lack of vaccinated have "zero" to do with the spike. It certainly contributes, but I am not pretending it's the sole driving force, or even the main driver. Covid infected illegals are certainly playing a role, a major role at that.
Secondly, are you trying to suggest all these illegal aliens never get past Texas or Arizona? They aare spread throughout the entire country, mostly ending up in poor or working class minority communities. These are the very communities which have the lowest percentage of vaccinated people. Surprise, surprise, the virus spreads through those communities and everyone else they interact with, black, brown or white.
I'm just saying let's not pretend that this spread is the result of white Republicans alone as the leftist narrative spouted by the Biden administration and their media mouthpieces would have us believe. There are other factors at play and a major contributing factor is the hundreds of thousands of illegals pouring into and all around the entire country month after month.
