Temp Halt gets overturned?

The constitution gives the president the power to decide on immigration and national security. Not the judiciary.

But the judge asked 'how many people from these countries have committed crimes here?"
That is not a constitutional question. It's him attempting to usurp authority by claiming he knows better how to protect us than the president. Not his authority.

And in order to steal this authority for himself, he gives those two states standing to bring the case when they don't have any standing.

The whole thing is a sham. The correct thing to do is to begin impeaching these judges when they pull this crap.

And the excuse that they can't get two thirds, so 'never mind' doesn't wash.

Impeach them anyway in front of the nation even if the corrupt left won't vote to remove.
 
I don't think that anyone who takes any pride in his work would be indifferent. Attorneys may be advocates, bordering on the mercenary, but the buck stops with the judge. Unless the guy's losing his mind, I'm pretty confident he takes his work seriously.

9th Circuit has their rulings overturned 80 to 90 percent of the time year after year. Someone who took pride in their work would at some point ask themselves what they're doing wrong. Only someone who is completely indifferent would continue marching down the same path as they do. It is painfully obvious to anyone with even a shred of intellectual honesty that this court does not even remotely care about ruling on the constitution as written. The pass judgements ruling on how they wish it were written. Judges who are overturned to this degree need to be removed. There should be some type of minimum standard that a judge must keep.
 
There's always more when you scratch the surface.

I understand the number of reversals against the 9th is relatively proportionate with appellate circuits generally across the country. The Supreme Court have been changing law particularly to do with constitutional matters associated with criminal procedures, which leaves the circuits having to follow existing law until the changes are made explicit enough to use as precedent. that would be one reason why SCOTUS find themselves reversing lower courts. Don't forget the 9th deals with over a fifth of the country's population and so has an equivalently large federal caseload. In those circumstances a greater number of reversals would be expected.

At least this seems to have taught President Captain Chaos that he has to take law and due process as well as politics more carefully into consideration when he issues edicts as ill conceived as this one was. He just won't be able to ignore legal ethical and moral codes. A properly formed executive immigration order without rollback (he's already had to) more carefully considered not to cause chaos , uncertainty and disregard to constitutional law affecting persons who come under US jurisdiction, would probably have succeeded without much controversy.

Actually the average rate of reversals for appellate courts ranges between 60-75 percent. The 9th ranges between 80-90. They're latest judgement didn't even state the statute that they ruled against.It couldn't as their opinion had absolutely nothing to do with the statute and was a purely political position, which is par for the course with this court. The statute is crystal clear giving any president complete and total authority to limit or restrict immigration of aliens. One may disagree politically, or even on moral terms. You may think it will be ineffective. What you cannot do is claim it to be uunconstitutional or illegal in any way and then pretend to be concerned about the law or constitutional rights, which by the way aliens wishing to immigrate have none. This falls squarely into the category of frivolous lawsuits,something the left is very adept at and will now vigorously employ as a stalling tactic.

Trump could easily have gotten this done had it not been so badly thought out and rushed through, affecting hoards of ordinary people it never should have.
Hair Force One needs to cool his jets and try think a bit more. The 'I'm President anything I say goes' approach doesn't work and nor should it. Didn't work for Nixon, won't work for Trump.

"I was a good student. I comprehend very well, okay, better than I think almost anybody." Next time he should get "almost anybody" to write an immigration order.
