Supreme Court Overturns Sotomayor

Quote from AAAintheBeltway:

I applaud this decision, but the real problem is an old decision called Gregg v. Duke Power or something similar. The Court there ruled that an apparently neutral test or promotion method that yielded racially disparate results was evidence of discrimination. The EEOC later issued a finding that such results created a presumption of discrimination that the company had to disprove. I may have the details slightly wrong but that is the basic legal structure. Sotomayor's decision applied this framework to the Ricci situation. The result may not have been compelled, as there was no direct precedent, but clearly the spirit of the Duke Power case was that a test that produced only white promotions was suspect. The city could have gone ahead, and been sued by blacks, or startd over, and get sued by whites. Probably they lose either way, which is a hell of a legal system to have to live under.

The eirony of sotomayor's decision is that it seemed tobe the exact opposite of what Obama claimed to be looking for in a justice. Her decision was letgally supportable but totally unfair and unjust in practice. I doubt it caused her any anguish however. She is clearly from the racial spoils system theory of justice. I don't think the Supreme Court's reversal of her decision is necessarily grounds to vote against her, standing alone. That said, she is a terrible candidate and there are plenty of respectable reasons to reject her.

Again, this is a ploy.

TeamObama knew this wasn't gonna fly.

I bet they were surprised it was 5-4.

But the fact it was 5-4 makes it all the better. C all those Angry White Men celebrating on TV, and one sellout Mexican.:D

I don't think the overturn is grounds to vote against her, but it sure is great seeing the Obama admininstration eating crow. They ought to have grown accustom to it.

If anything, this will solidify her position.

Quote from Eight:

Karma? What usually follows the disenfranchisment of the capable ruling class is collapse of the culture... we are headed for Warlord territory with these goodie goodie biatches we have in charge killing off incentive and redistributing the profits to anybody that can vote for them... it's just a stage in the collapse, where women and children run the culture...

If the so-called ruling class were able to b disenfranchised then they are no longer capable, now are they.

Worse, if u examine ur words ur ego says that ur entitled to rule. And the fact that people have challenged that assertion make u petulant. That is what is killing the Angry White Male.

Quote from fhl:

The people you quote not only think that disenfranchisement of whites is justice, but that it may even result in a better society.

They have to bury their heads in the sand and not look at places like Zimbabwe and see what happens when you take from the <s>rich</s> whites, and give to the favored classes, whether it be unions or people of color. Or others seem to think they'll just be an observer of the mess that results and not subject to its hellish consequences.

Obama policies are taking us down the very same path as Zimbabwe and the Entire nation suffers for it, not just subjects of so called 'karma'.

Did everybody in Zimbabwe stay? Nope.

Did every Jew in Germany stay?
Nope.

If it gets serious enough..........

I have given the answer to this type of warfare b4. Leave the man alone. Attack the ideas.

And for the right to have any credibility at all to the buffalo u will have to separate urselves with vigor from Stromfront.

Pabst and Mag Light r avowed racists. Congratulations for their candor. The price they pay is that any criticism of Obama will b dismissed out of hand.

Rush is in that same boat, although he has not actually said that he is racist a strong case of his soundbytes has been used against him, and since Rush is associated with conservatives, and conservatives are associated with the pubs. Even the moderate pubs are guilty by association.

This is the perception, the image. In Hollywood and Politics we all know that image is everything. :)

Ginsburg opens her opinion by observing that "the white firefighters who scored high on New Haven's promotional exams understandably attract this Court's sympathy." To which Alito replies:

"Sympathy" is not what petitioners have a right to demand. What they have a right to demand is evenhanded enforcement of the law--of Title VII's prohibition against discrimination based on race. And that is what, until today's decision, has been denied them.

Presumably if the plaintiffs belonged to a group for which Ginsburg had "empathy," she would have been more inclined to rule in their favor. "Sympathy," by contrast, is an empty sentiment offered to disfavored classes in lieu of equal protection. Such distinctions between classes of people cannot be reconciled with equality under the law. "Sympathy" is the new "separate but equal."

The Penguins beat the Red Wings this year 4-3 in the Stanley Cup. I'm sure Red Wings fans think they actually won since it was only a 1 game win.

Quote from ARealGannTrader:

Did I say that Rev. Wright was not a racist, from what I have heard?

But, let's deal in perception because perception for the Buffalo are 90% of reality.

It is perceived that blacks can b mad about their past and vent about inside their churches. The fact is that most whites who would not use nigger in public sling it around like lemonade when at home. But those same folks will swear on a stack of bibles that they are not racist.

So, yes, Rev. Wright's sound bites appear to b racist in nature.

Huh? Have you heard a rap song lately? They drop the N every other word.

What I find really funny, is we ARealConnTrader calling everyone else racist, but he seems completely fixated by race. He does not see Ricci as a firefighter, he sees Ricci as an Angry White. He sees the rest of the firefighters as 19 Angry Whites and one Sell-out mexican. He does not see Obama as the President, he sees him as a black. He sees Sotomayor not as a judge, but a Latina. He does not look at a persons record, or their position, he simply looks at their race and makes a judgement. If anyone has any issue with race, it seems blatantly clear ARealConnTrader does.
