Good question.

The key is level of culpability.

Kid being charged with first degree murder.

Parents being charged with involuntary manslaughter.

Both charges can exist because it is.2 different trials and parents are being charged for the contribution not the cause of the main crime. Kid definitely.killed people and shot up the school and is charged to be held accountable.

Parents CONTRIBUTED but also had a means to stop the crime possibly from occurring.

If.I drive drunk.from a party and.kill.someone.my defense is NOT that the host gave me the keys even though i was clearly drunk. The host has his own criminal and civil liability apart from my actions.

The law is whatever a jury will convict them of and i doubt there is a jury in America that will acquit any of these three.

I am challenging the ethical decision to charge this shooter as an adult. He obviously has/had awful parents and other challenges. This is why juvenile justice is carved out in the justice system of America.

I must say I never understood why America and only America to my knowledge in the developed world charges children as adults. He is a murdering little demon but he IS a child and all that comes with a developing brain.

I recall being 13 and hatching a full plan in geography class to use fourteen diesel injectors to flash vaporise a gallon of gasoline into a perfect air-gasoline mix and blow up my school, though on a Sunday to he fair, I only wanted smoking rubble not death. I even had an idea to use a very tall steel catering trolley to focus the charge into a main structural part. I would have blown all the doors and windows out at least, not a huge school.

I just can't recall why that geography class had me so pissed off but teen brains think teen thoughts.. We all had some weird shit go through our heads some days.

Its fear of the parents that keep most in check but now the adults are just idiots.

Eh, weak excuse to brush away 4 dead. The argument can be had whether to charge him as an adult and give him life in prison right off the bat. Or charge him as a minor and give him life in prison to start his sentence in juvie I supposed. The apprehension is likely due to the fact I've never seen life in prison sentences if tried as minors. Though I recall some 8 year old redhead that smashed some little girl's brain in with a rock.
 
I know that I am repetitive on this point but I keep saying I need to see more.

For example, I saw some pundits, including psychiatrists on the tube affirmatively stating that a teacher caught the kid looking at ammo on his phone and his mother knew that and it was an enormous red flag. Nope. Not really. I understand that from the view of people who think that just being interested in guns is evidence of being a mass shooter- but a defense team can successfully and rightfully argue "no, the kid was in a family that had just bought a new gun and he knew that he would be shooting it and school is boring as hell and what kid in his right mind would not be googling around about it. My desk at school always looked like a library of hunting and fishing and gun magazines.

But if you mix other information in with it, if, for example, you tell me that the teacher was highly alarmed because she was aware of other utterances and behavior of the kid then I can get there very easily as far as it being a red flag.

More info needed before I automatically conclude, as the pundits are, that looking up info on ammo is red flag. It is only in conjunction with other knowledge.

I think you make a mistake by comparing the guns and ammunition available to you as kid to the guns and ammunition available today. I remember you made the point kids had rifles in the trucks in the parking lot of your high school but a rifle for hunting is not an AR 15. The clips, and I don’t know if clips were available to you as a kid, didn’t hold 15, 30, 50, 100 rounds. The bullets weren’t hollow points that would shred the internal organs of a victim. Guns available today are combat weapons.

And to the point about the kid searching ammunition in today’s day and age, you better believe that’s a red flag. Hello? Have you read the news in America lately?

Among other things that will be in the report- and I have stated this before- several times. One of the lefties here has repeatedly scoffed at it and dismissed it, so that is pretty much the confirmation I need.


The report will include among other things:


- Issues related to McCabes failure to recuse due to his wifes dnc funding. And failure of Comey or Rosenstein to oversee it.


- Issues related to McCabe and company deliberately slow-walking the emails discovered in weiners/humas laptop. ie, deliberately not reviewing them to let the election blow over first.


-Issues related to Comey’s absolutely drop-dead atrocious handling of the announcement of no action against Hillary. Comey was not even in the prosecutorial division of the DOJ and not even remotely in the chain of command if Loretta recused. It should have then defaulted to Sally Yates or Rosenstein or a couple others. The IG is going to have major heartburn over that. It is just nuts.

-There are enough hours in the day to even begin to outline the issues he will have with the FBI’s handling of witnesses that were in Camp Hillary. That will drive him nutso too. The FBI immediately moved to give them all immunity with absolutely nothing received in return. And then issue after issue on top of that. He must have just been shaking his head when he looked at all of that. I am going to guess that the IG does not think they are in the business of handing out HQ Specials.

- I would imagine that the IG will have issues with the DOJ/FBI being chronically unable to find emails and not maintaining back-up procedures -possibly deliberately. Remember when the FBI tried that little stunt again with Congress and said it did not have McCabe’s, Pages, Strzok etc emails? And then the IG said “not to worry” I have them even if you clowns don’t……and he did.



- And then there is the bonus issue that I throw in knowing that there is some chance that I am wrong and the tards will stick it up my bo-bo. Nevertheless, I stand by the idea that the IG will not take a pass on addressing that whole Tarmac Clown Show. It does not matter to me in the least that it is no longer an issue in the press or here on the forum. My assessment of Horowtiz’s professionalism is that he will not let it pass. The IG is not a criminal investigator so I am not saying he will reach any conclusions on whether collusion took place there. But as the chief guardian of departmental rules and procedures, I do think he will have a major issue with the fact that the FBI immediately looked the other way rather than investigating it and focused on threatening the person who took the photo rather than developing the facts. I could be wrong and if so I will hear about it. And if I am right I imagine I will hear less.

And then of course there will be other issues - hopefully many surprises. Rosenstein will take hits on issues I dont even know about. He is a target rich environment. And then Comey will take hits on things - many that I do know about- including leaking, failure to manage misconduct by his staff, the hillary announcement thing, and on and on.

I don't see the parents hanging together on this one. The prosecution will give them different "offers" along the way. And the defense will want it too.

You have problems with testimony and marital privilege and all of that on the horizon too.


marital privilege will certainly be invoked but since the parents posted on social media and there are text messages the police recovered and the testimony of the school staff..... we odnt need the parents to even say shit.... they hung themselves with their own posts and text messages and the kids social media.

If I were a DA I would not even need the parents to open their mouths to "hang em" and no way a Defense attorney has them testify anyway.

their only defense is there is no legal obligation to secure the gun in MI that could lead to direct penalties and that they could never have imagined their kid would do this. But in order to plead that defense they will have to testify to it and they are the shittiest witnesses around given their social media history and text messages to their kid.

The parents are fucked because like all fucktards they display their fucktardedness in texts and social media which speak for themselves and no attorney would allow them to take the stand.

Commit an adult crime get charge as an adult..... the fact that he is 15 is not relevant for this kind of crime. I see no ethical dilemna in challenging a kid who killed four students and injured many others in a calm and cool and collected manner and terrorized an entire school.

This i not a juvie violation... this is real adult shit and he should die in prison.

Oh pooh. You are getting all your info from the media and trying to understand guns from a soy-boy, city-boy no knowledge perspective.

The notion that hollow point is somehow a recent military-application bullet only intended to kill people and never used in hunting is an absurd position that comes out of media scripts these days. Hollow points have been around and used in hunting for well over a hundred years.
