For some reason unless I missed it, the gun charge was not part of this trial...it is not something that goes to trial, you are cited for it at the moment of arrest so not sure what happened to the charge.

Incorrect. --- In a trial the charges listed in the indictment are the charges you are being tried for. Th indictment is typically returned from a grand jury. What you are charged with at your time of arrest is not necessarily the list of charges you will face in trial from the indictment. The DA drives the indictment and charges.

In this trial for Rittenhouse -- "The count that the judge just dismissed, which was listed as Count 6 in the indictment, was a misdemeanor stating that Rittenhouse was under 18 years old with a dangerous weapon."
 
Must be embarrassing to be a Democrat to know that the Governor had to deploy 500 troops because you cant trust that Democrats wont go bananas and start fires on a verdict they don't like

As I said I missed it because I did not dig into the shit... if it is just a misdeanor that is crazy. How can someone underage holding and using a gun only be a misdemeanor.. not like it is buying cigarettes.

Judge Bruce Schroeder just dismissed Count 6 of the indictment against Kyle Rittenhouse, a misdemeanor charge for possession of a dangerous weapon by a person under 18.

The charge was punishable by up to nine months in prison and a $10,000 fine.

Rittenhouse now faces five charges.

He's actually made a few rulings that help the prosecution..to allow presentation of lesser charges, and to instruct the jury that Rittenhouse may not have a right to self-defense if he was the initial aggressor. Let him do his job.
 
I predict he will get at best the lesser of all charges nad separately some illegal possession charge of the weapon if he did not carry it over state lines. Still was underage with a weapon. Jury instructions were about homicide/manslaughter with depraved indifference or negligence. Plenty of negligence in there but tough to call how a jury would see it.

If you recall the FUBAR of the jury instructions this morning, the court agreed, after some back and forth, that if the jury finds Kyle not guilty on the greater charge with self-defense, then there is no need for them to consider the lesser charge on same count in any capacity, self-defense or not.

His job is not to dismiss charges that should be up to a jury if he wants to be seen as impartial
