Prosecutors Move For Mistrial As Jury Has Been Tainted By Clear Video Evidence Of Kyle Rittenhouse

And by the way...You know what is really fucking annoying?

While watching these networks like CNN, when the court takes a 2-minute break for a sidebar, and then John King or whomever comes on and starts engaging his panel of commentators, they start rambling on about whatever. All the while they have a separate camera shot of the court cam.

So as the commentators are speaking, the court cam shows that the judge or whomever are then speaking again. So John King then says, "I'm sorry, we have to go back live to the courtroom, the judge is speaking, in the trial about Kyle Rittenhouse and the defense made a motion and we must now go back live to the courthouse to hear the judge to hear what the decision was about the motion and we are bringing this to you live so you don't miss any..."


It's like, John, STFU! You have just talked over 15 seconds of what the judge had to say, so now we have no idea what was said! We understand context, dude! We can read the Chyrons at the bottom of the screen! We have been watching the thing for hours. Will you just let us hear what is going on? Absolute TOOLS over at CNN. Oh, and that Trial and Justice network is even WORSE! OMG, they go to commercial in the middle of testimony!

His duty is dismiss charges if they can't stick as a matter of law. The jury decides issues of fact. He can also set aside a jury verdict or dismiss charges if the evidence viewed in the strongest light for the prosecution can't support a finding of conviction on a particular charge.

He seems like a good judge.

Actually a judge can dismiss the charge when they can cite the law and demonstrate clearly the particular law is not relevant to the case. The judge made a very clear citation when dismissing this particular count (Item 6 in the indictment).

Some of the press took the judge's earlier comments on this particular misdemeanor charge and his dismissal today of the charge as a sign that the rest of the prosecution's case was week -- however legal analysts seem to indicate that this dismissal means little to the remaining counts in the case.

In this case the prosecution actually told the judge that the weapon wasn't illegal (had to do with the length of the barrel) before the judge dismissed the charge. Just heard the sound clip.
 
It’s now with the jury.

I don’t know how this case will go. IMO he might be cleared of the charges — but it is just as likely he is found guilty of one or more charges.
 
Rittenhouse trial heads to jury after defense accuses prosecutor of lying in closing arguments

Richards spent part of his two-hour closing argument accusing Assistant District Attorney Thomas Binger of being "a liar" who misrepresented evidence and "changed his strategy" to fit evolving narratives after his original case "blew up in his face."

"This is not a game," Richards said. "We don't play fast and loose with the facts."

Earlier in the day, Binger told jurors Rittenhouse was in Kenosha looking for trouble and accused him of being a "wannabe soldier acting tough," saying he "ran around with an AR-15 all night and lied about being an EMT."

Binger said "the only person who killed anyone was Rittenhouse" and threw doubt on the teenager's claim he was there to "genuinely help."

Binger showed the jury a segment of drone video that he said depicted Rittenhouse pointing the AR-style rifle at protesters in the streets.

“This is the provocation. This is what starts this incident,” he said.

Jason Lackowski, a former Marine who said he took an AR-15 semi-automatic rifle to Kenosha last year to help protect property during violent protests against racial injustice, said that Joseph Rosenbaum “asked very bluntly to shoot him” and took a few “false steppings ... to entice someone to do something.”

Lackowski got up from the witness stand and demonstrated what he meant by “false stepping.” He took a small step and slight lurch forward, then stopped.

But Lackowski, who was called as a witness by the prosecution, said he considered Rosenbaum a “babbling idiot” and turned his back and ignored him. He admitted he didn’t see everything that went on between Rittenhouse and Rosenbaum, including their final clash.​

Rosenbaum served time in prison for child molestation and had just gotten out of a mental facility with his possessions in a bag:

During the clash with Rittenhouse, he threw a clear plastic hospital bag that he had been given to hold his toiletries.​

And there is this damned video I recall from the Dave Letterman Show with Bobcat Goldthwait that joked about it. I don't think I can find it, but that is what I see in my memory banks...
