The judge threw the motion because there are no sympathies in court as I've said before and the law is clear about fucking children, no matter how "willing" the child was about the whole thing. They still botched the case on dna. I still fail to see how a lawyer should be negligent about her duties even if it means throwing a hail Mary defense.
