Don't explain it to me. Explain it to the Justice Department and even Mueller who acknowledges the legal opinion of the DOJ- which has become policy and a directive to its prosecutors. Explain to them why their own policy/internal legal ruling applies to presidents other than donald trump but not trump.

Ok I'm back briefly. Just enough time to state there are two fronts on which Kavanaughs reasoning is flawed with regard to the Imperial Executive. The first is fundamental. The second is practical.

In the interest of time, I have very little as cocktails await, I will summarize the fundamental flaw by noting that his argument rests on the President being above the law. There is no support for this in the constitution from the textualists viewpoint. Kavanaugh is a self proclaimed textualist. There is however an incontrovertible originalist argument that can be made against Kevanaugh's position. Scalia was a self proclaimed "originalist." Scalia woul make the argument for me were he here. He's not!

With regard to the practical flaw in his reasoning. I am totally out of time. But I invite you to visit in your own mind these two aspects of Kavanaugh's theory of the Imperial Presidency, and see what you can come up with on both fronts, fundamental and practical. Good luck. No. Fail.

His argument is not that the president is above the law. It based on the premise that there is a sequence required by protections that the president has under the constitution while in office, and the constitution has supremacy over statutory law. To say that he is arguing that the president is above the law is to say that the president is beyond every being prosecuted under the law. He has never said that, and has said the opposite. No need to worry about the cocktails muddling your understanding, it was already goofy.

In any case, as I said, you view does not matter. He is going to be confirmed even though in your mind you have more legal knowledge than he and the DOJ do. Let's note together that you crabwalked away from the point I made which is that the DOJ attorneys/DOJ policy also takes the same view as Kavanaugh does. Yeh, that's a little inconvenient truth for you right there.
