Another Lawsuit Filed Over Obama's Citizenship

The Cincinnati Enquirer reported Sunday that an Ohio man is suing to find out whether Democratic presidential nominee Barack Obama was born in Hawaii or in his father's native Kenya.

David Neal of Turtlecreek Township, Ohio, filed his lawsuit Friday in Warren Common Pleas Court, the newspaper said.

Neal is seeking to have state and federal officials settle questions over Obama's ability to be president since the US Constitution requires presidents to be, among other criteria, natural-born citizens.

"Mr. Obama has failed to demonstrate that he is a 'natural-born' citizen," Neal said.

Much of the wording in Neal's suit mirrors language in a similar challenge filed by Pennsylvania attorney Philip Berg. That lawsuit was rejected Friday by US District Judge Richard Barclay Surrick of the Eastern District of Pennsylvania,

Berg said he intends to appeal to the US Supreme Court.

That's four currently running at my count - Berg's federal suit, the state suit in Hawaii, the state suit in Washington, and now this one in Ohio. And there may be more coming.

I mentioned this before, but I'll repeat that it is within a state's rights to hold back on a candidate's electoral college share if he does not satisfy their requirement to adhere to the constitutional demand of the candidate being a naturally born citizen.

I quit reading your post right here because you are such a dimwit you are not worth reading. I never claimed anything was false. The pics are of an issued version, not the original vault certificate of live birth. The issued version is an abreviated version. The whole story of Obama's birth is only on the full vault version. It is important because in Hawaii it is possible to obtain a birth certificate without having actually been born there.

Now go get educated, then come back and apologize for being such an idiot...

First of all its NOT his birth certificate or even a certified copy of his birth certificate. Its an official certification of Obama’s birth in Hawaii by the person in charge in Hawaii. Its printed on Laser paper which means its new, not from the 1960’s. It simply states that Obama was born in Hawaii according to whoever printed out the form. Its a certification, not a Certificate of Live Birth — totally different.

That particular form is not even good as a form of ID if you don’t have a passport on a cruiseship or are going to Mexico. The reason is that you can actually request a state to correct your BC with a AFFIDAVIT AND CERTIFICATE OF CORRECTION and they will type all the info in that you fill out on that form, without ever even looking at your Certificate of Live Birth. So what you have on record is the amended version, and unless you actually see the Certificate of Live Birth you would never know that there was a difference or even a certificate at all. The issuer of the short form, which you are displaying, is simply printing out whatever has been typed into the computer from the certificate of correction form.

My son has worked in vital statistics at this is what he told me. So in order for there to be a true confirmation of Sen. Obama’s Citizen status, you will need an official copy of the Certificate of Live Birth.

To get a birth certificate issued for a child, the parent(s) fill out an application. The parent certifies the accuracy of the information by signing a section which essentially states the information provided is accurate. (like the verification statement you sign when filling out your tax return which verifies the accuracy of the information).

If a child is born in a hospital, a hospital staff person certifies the information in one section of the application and provides the staff person’s name and the hospital where birth occured.

However, not all children are born in a hospital so this hospital certification is not required in order to issue the birth certificate.

Therefore, it is possible that the canidate’s mother delivered her son in Kenya, possibly because most airlines won’t let you fly after a certain date in your pregnancy. After, his birth in Kenya, his mother and he arrive in Hawaii. She gets the application to apply for a birth certificate and to avoid “problems” — she’s about 18 remember, she just puts down that he was born in Honololu, Hawaii. And signs the document.

She’s not a lawyer, probably can’t afford to consult with an immigration lawyer if she thought about it and she is likely not an expert on Immigration and Citizenship laws. All she wants is a birth certificate for her son and she’s a U.S. Citizen right? What’s the harm. None really until her son decides to enter politics and run for president of the United States which requires that all canidates be “natural born” citizens of the U.S. i.e. born in the U.S. or conferred that status under the Immigration and Citizenship laws at the time of birth. Naturalized citizen is one who applies for citizenship as an immigrant or if child born abroad and seeks to assert child’s right to dual citizenship (where parents of child are of different citizenships). The Constitution does not allow one who holds the status of “naturalized” citizen to qualify to run or act as president of our country.

So, what is needed is either an original (Vault) birth certificate showing the hospital, or the application which shows the hospital staff person and hospital where he was born in Hawaii, or the actual hospital records.

Otherwise, all we are relying upon is an eighteen year old girl’s assertion of where her son was born. Given the alleged statements by his paternal grandmother circulating around the web that the grandmother was at his birth in Kenya, the question is a legitimate one given the constitutional requirement that one be a born in U.S. to run and act as president of the U.S.

If he was born in Kenya, then the Immigration/Citizenship statutes govern whether she can confer “natural born” citizenship status. According to the lawsuit filed by a former Deputy Attorney General for Penn., the applicable statute in 1961 stated that for a U.S. citizen to give this status to their child born abroad at least one parent must have resided in U.S. for 10 years before the child’s birth AND the parent had to reside in U.S. for 5 of those years after age 14. His mother was 18 when he was born, not 19, so she wasn’t eligible to confer “natural born” status to her son Barack if he was indeed born abroad.

I am curious why his maternal grandparents haven’t spoken up to clarify the issue as one would think they would know where their daughter was while she was pregnant and where she was when she gave birth….unless they were not in contact with their 18 year old daughter during this time period.
