Neanderthals vs. "Science"

The Feds were due for their monthly review of mask policy on April 18th to see if it would be extended. Last week the Feds extended the mask requirements for two additional weeks. At this point the question becomes -- do the Feds simply let the policy lapse and not challenge the ruling since the they were expected to eliminate the policy in two weeks anyway, or do they appeal the ruling to establish that the Feds have the right to mandate mask on transportation during a global pandemic. I expect they will likely appeal.

I just read her bio. What history of supporting Trump prior to her appointment?

Upon graduating from law school, Mizelle served as a law clerk to Judge James S. Moody Jr. of the United States District Court for the Middle District of Florida and to Judge William H. Pryor Jr. of the United States Court of Appeals for the Eleventh Circuit. She worked as a trial attorney in the Tax Division of the United States Department of Justice from 2014–2017, and was detailed as a Special Assistant United States Attorney for the Eastern District of Virginia from 2014–2015. Mizelle was Counsel to the United States Associate Attorney General from 2017–2018. In 2018, she briefly clerked for Judge Gregory G. Katsas of the United States Court of Appeals for the District of Columbia Circuit, and then clerked for Associate Justice Clarence Thomas of the Supreme Court of the United States. Mizelle is currently an adjunct professor at the University of Florida Levin College of Law.[5] She has been a member of the Federalist Society since 2012.[2][6]

Before becoming a judge, Mizelle was an associate at Jones Day.[7] There she worked on civil and criminal litigation and appeals.[4][8]

Let's take a closer look at this totally unqualified federal judge appointed by Trump who has no meaningful trial experience whatsoever prior her appointment.

Trump-Appointed Judge Deemed ‘Not Qualified’ by Bar Association Voids Mask Mandate on Planes, Other Travel

The TSA says it will no longer enforce the mask mandate in light of U.S. District Judge Kathryn Kimball Mizelle’s decision

A Trump-appointed Federal judge in Florida has voided a national mask mandate for airplanes and other transportation. “Wearing a mask cleans nothing,” U.S. District Judge Kathryn Kimball Mizelle wrote in her decision on Monday. “At most, it traps virus droplets. But it neither ‘sanitizes’ the person wearing the mask nor ‘sanitizes’ the conveyance.”

Mizelle, 35, was only eight years out of law school at University of Florida when Trump appointed her to the lifetime position in 2020. The Daily Beast noted at the time that her only trial experience was as an intern, and that she held four clerkships, including one for Supreme Court Justice Clarence Thomas. Mizelle was rated “not qualified” by the American Bar Association prior to her appointment, citing her lack of experience.

The transportation mandate case on which Mizelle ruled was filed on behalf of a group known as Health Freedom Defense Fund, as well as airline passengers. Mizelle said that the Centers for Disease Control had exceeded its legal authority, that it had failed to justify its decision and follow comment protocols, and that the mandate was “arbitrary and capricious,” according to The Washington Post. The CDC had announced earlier this month that it extended its mask mandate to May 3.

The Transportation Security Administration (TSA) said it will no longer enforce the mask mandate in light of Mizelle’s decision, according to CNN.

The Biden administration was dismayed by the ruling. “This is obviously a disappointing decision,” Press Secretary Jen Psaki said at a press briefing on Monday. “The CDC continues recommending wearing a mask in public transit.”

Republican leaders on the House and Senate transportation committees pressured the Biden administration earlier this month to end the mandate or decline to extend it. The Senate voted last month to overturn the public health order requiring masks on airplanes and public transit, and, as the Post points out, 21 states, most of which are led by Republicans, sued the government seeking to end the mask mandate. CEOs from airline companies have also urged Biden to lift the mandate.

Fortunately for the mandate’s opponents, the former president was able to appoint a slew of unqualified judges.

Well, if you expect they will appeal, they probably won't - given your record on prognostications. All airlines are suspending it and no masks are in the airport and planes as of today, unless people want to wear them (Karens like you).

I did have to laugh at our local news last night. They rushed down to RDU airport to do a report on mask use being suspended. They focused their cameras people leaving the airport security area --- and could not find anyone not wearing a mask. Their cameras finally found one man walking without a mask then they interviewed a lady holding her mask in her hand who stated she was happy to see the mandate stopped. At the end of the broadcast segment they were finally able to find two men walking out without masks.

I expect today will be a different story.

They rated her as unqualified because they said "12 years of practice experience and “substantial courtroom and trial experience as a lawyer or trial judge is important". And she did not have this.

But they also said:

“Ms. Mizelle has a very keen intellect, a strong work ethic and an impressive resume,” the standing committee’s letter said. “She presents as a delightful person and she has many friends who support her nomination. Her integrity and demeanor are not in question. These attributes however simply do not compensate for the short time she has actually practiced law and her lack of meaningful trial experience.”
Still, you claimed that "She has a history of supporting Trump prior to her appointment."

I asked you to support this statement, and you - as usual - ignored it and did not answer.

At the end of the day, mask mandates on airlines will be ended because of her decision, and she'll be lauded as a hero to most of the country for that. Must really chap your ass.

Maybe you need to go to open secrets and take a look at the record of her and her family members donating to right wing politicians and political groups. Everyone from Sessions to Trump backing PACs.

Maybe you can show us what you mean, since you are the one who made the claim that you cannot seem to backup. Don't just say "go read", like you always do.

Giving money to Republicans doesn't mean shit. Just means she is a republican. Doesn't mean she has a history of supporting Trump like you claimed.

Look at the bright side: she managed to not declare fiat money unconstitutional in her ruling somehow.
