Multi-chart Ripping Off Tradestation

Quote from JaiSreeram:

Going through this thread, my question is about the Migration Tool of TradersStudio and Easy Language. So, with reference to your money management thread (http://www.elitetrader.com/vb/showthread.php?s=&threadid=119308), how can you, Mr. Murray translate the same? What about the copyrights and legal issues?

In our case we don't read the native .ELD format. We require the end user to paste their code in in text form. Their code , their ideas, which are protected by the first amendement to the constitution.

This is the point that SuperCruz continues to ignore. Look at the first reply in this thread

SuperCruz rather than feeling inadequate as you have been unable to bait Andrew into responding, you should instead be wondering why no one from TradeStation has felt the need to defend their inaction in supposedly defending their copyright.

Please answer this one question, I’ll make it easy for and provide multiple choice.

Why have TradeStation taken no action against TS Support?

1) They have been too busy improving their platform and adding international data feeds that they failed to notice MultiCharts has been around since 2004.

2) They have been too busy sipping Pina Colades and counting the G-Strings go past to notice MultiCharts has been around since 2004.

3) They welcome the competition.

4) There is no copyright infringement so there is nothing they can do.
As a long time TradeStation user it's crystal clear to me that answer (1) is not remotely possible.

FWIW, have been told by a programmer in the industry that two ex-Tradestation programmers have either migrated to or helped TSSupport develop MC. Keep in mind I only met the programmer by shear chance at an airport bar. Seemed genuine but wouldn't go into further detail. Surely could be utter nonsense/rumor, but perhaps others have heard similar?

Rumor.

Well, I did what you guys told me. I wrote to TSSupport & had a chat with them also, please see the attachment for the full chat transcript. I even contacted TradeStation, however I have not got any response so far.

Despite the responses from Multi Charts, I regret to state that I have not yet got any proof that it is legal for Multi Charts to use TradeStation code.

Thus, it seems that there is no answer to the question, so it can be any of the following:

  1. We have the answer as based on the fifth amendment of our bill of rights, which states that “I have the right to remain silent on the grounds that it may incriminate me”.

It means that if you were required to be at court to depose against something that you were a witness to, you have a right not to say something that might get yourself in trouble. Take a case, of a murder trial, where you are called as a witness and the fact is that you are actually the murderer. You have the right not to answer the question, “Do you know who killed him/her?”
  2. There are no legal issues, which cannot be as TradeStation uses the copyright words.
  3. The other case can be that TradeStation has given permission to MultiCharts to use their code, but yet to see some definite proof.
  4. Yet another case can be that previous TradeStation people are involved and TradeStation is closing their eyes unoffically, as shown below:

I leave this question open & hope to get a definitive answer some day or the other soon.

Well I think he has already answered it here:

Congratulations.

That should tell you something.

Thus you are still ignoring the obvious.

What's that got to do with it?

, which cannot be as TradeStation uses the copyright words.

The second half of that statement has no foundation.

Quote from SuperCruz:

3. The other case can be that TradeStation has given permission to MultiCharts to use their code, but yet to see some definite proof.

You are making the assumption that they need permission.

Quote from SuperCruz:

4. Yet another case can be that previous TradeStation people are involved and TradeStation is closing their eyes unoffically, as shown below:

Not true: http://forum.tssupport.com/viewtopic.php?p=12825#12825

The answer is in the transcript you posted....

TS SUPPORT:
I consulted with our legal department and according to them we are not violating any intellectual property laws or regulations.
SuperCruz:
okay

......

TS SUPPORT:
We do not see any legal issues here.
SuperCruz:
okay
SuperCruz:
Can I save this chat transcript & publish this at the ET forums
SuperCruz:
so that all users of TS are not worried
SuperCruz:
It seems that I was wrong & there are no legal issues

You finally got it!

doesn't that tell you something? WHO CARES? Even Tradestation think that it is a non-issue.

Either YOU are STUPID, or MultiCharts is stupid.
Do you think MultiCharts would be stupid enough to "steal" the indicator codes? If they can write a complicated Tradestation clone, they surely have enough ability to write a few EasyLanguage script. LOL.

Either YOU are STUPID, or MultiCharts is stupid.
Do you think MultiCharts would be stupid enough to have "stole" the code, then stupid enough to "forget" to delete the Copyright message ???? LOL

Despite the responses from Multi Charts, I regret to state that I have not yet got any proof that it is legal for Multi Charts to use TradeStation code.
Despite your rambling, I have not got any proof from you that MultiCharts has infringed any copyrights.

[*] There are no legal issues, which cannot be as TradeStation uses the copyright words.
How old are you? LOL
I can write the word Copyright a hundred times, all over the places. What does it assert?

[*] The other case can be that TradeStation has given permission to MultiCharts to use their code, but yet to see some definite proof.
WHO CARES ?

[*] Yet another case can be that previous TradeStation people are involved and TradeStation is closing their eyes unoffically, as shown below:
*Eyes rolling up*
You are masturbating too much.

I wasn't going to give a response, but what the hell, this is fun.
