MSO: Halted & Guilty

I understand what the law is saying but it makes little sense. In fact, it is not illegal to lie to most state and city investigators. The federal law is misguided and I pretty much agree with Pabst's statement below.

That's easy, but is a matter of "justice" semantics.

Legally "obstruction of justice" includes impeding an investigation. Most of us would agree that achieving justice would include the search for truth -- If one can lie to investigators at will then this would impede said search. "Justice" doesn't just begin when there are charges filed or a conviction -- it's a process that begins with the first questions asked. If we hope to find the truth, even when no crime was originally committed, there must be truth or teeth.

Of course the conspiracy charges simply mean that more than one person worked together in a coordinated effort to accomplish what is charged. The Jury determined that Martha and Bacanovic did just that in lying and hampering the investigation.

Arrogance and attitude here play an important role in the details behind the scenes....whether we think it is fair or not. Nobody should think that they are above the law, just because of their status. well, unless you are a diplomat visiting....ok but this is not the point...they even must follow international laws of conduct and provide apologies when needed.

I will be interested how much Martha apologizes publicly to get a reduced sentence....we shall see.

Being arrogant is not a reason to be jailed. If it were we would all be in jail from time to time.

I'm far from a supporter of Martha Stewart. In fact, I have long heard of her belittling people and have had pretty much contempt for her.

However, I really get angry when the government finds some unrelated law to jail and/or take money away from an otherwise innocent person.

Would Martha have sold her shares if Sam Waxel had given her insider information? Probably. Did she trade on insider information? NO. Insider trading is the ONLY possible charge that should have been brought against her if the government were fair. The other charges are total absurdity.

These stories about the line in the coffeshop.....about the dollar....I did not know about that....But the arrogance of that family I do know about....

I believe it makes perfect sense to expect the truth in an investigation and to back that expectation up with teeth.

I'm a bit confused as to the logic behind those that feel differently. In the quest for justice, we have the right to SAY NOTHING!!! -- why do we also need the right to mislead at will?

I really don't get it.

But the irony here.....if she had just cooperated she would not be where she is today.....can't you see that?...if you knew the details you would understand.

The investigators have a difficult job to do...and conspiracy is a common charge....It is not an abuse usually. Sure there are exceptions, but not in this case. Ok, she is high profile and if you are going to make an example this is the one to go for...But if she were smart and cooperated...the charges would have been dropped...she got scared and got some bad advice...But, the arrogance and the attitude did not help....

P.S. in our free country we are all entitled to our rights.....some think this more than others.....Now the rebuttal to this will come but please re-read it carefully and see what I am saying.

P.S.S With status comes a bigger responsibility.....so in this sense we are not all equal......ok? I say this because she is responsible for many peoples lives directly and indirectly with her actions. We are a civilization built with a social structure, and in our country, with elected governments right?

In general, the Gov. is not interested in justice. The Gov. is interested in a successful prosecution, at any cost.

Superman disabled to Martha's ducks not being in a row....kinda ironic, where we put our security....... LOL :)

P.S. But this seems natural to build a case to ultimately bring someone to justice. Obviously if this were happening to me, I might feel differently. I would not want to be in Martha's shoes right now.....

P.S.S. Question....If your being investigated and your truly innocent...even if your being singled out....what would you place your faith in?

In general, the defendant is not interested in justice. The defendant is interested in a successful defense, at any cost.

And that is why we have Juries.
