if you new anything about how the Supreme Court reviews constitutional tests... you would know you know the answer to your question may lie how the judicial review proceeds.

Does the state law have to meet a rational basis test or strict scrutiny.


In theory it might be argued a state could unfairly discriminate against white males... and the U.S. Supreme court would defer to the state govts right to do so.

So in theory.. a law could be unconstitutional if the federal govt did it, but the court would bow to state's rights.
 
Technically, states have a right to appeal to the Supreme Court. The Supremes then decide whether or not they want to hear the case.
