Why can't Lawyers Preemptively file class-action suits against the Government for violations of our Constitutional Rights?

I hate to inform you of this but the NJ Supreme Court does not now, never has and never will decide what violates the US Constitution. The US Supreme Court decides these issues. The US Supreme Court takes a very wide view of federal powers and a very narrow scope of the 10th amendment.
