Do I have to have sworn statements from the grandparents to make a comment? Al I said is that I feel bad for the 18 month old and asked if the grandparents could bring him home because his life is in danger with his mom.

Ahh, no. He has no entitlement to come here via the status of the grandparents. The point has been covered and you do not agree with it so I will let you be off on your own little trip there. They may be entitled to apply for or request certain things and processes but they are not entitled to a specfic outcome guaranteeing that he can come. Anyone, anywhere is entitled to request anything. The child of an american parent has an absolute entitlement to citizenship. No such absolute entitlement exists via the status of the grandparents who were naturalized later.

The mother has rights too. She gets to have a say in whether her child is - pursuant to your plan- exported to the U.S. You are getting ahead of your skiis here and projecting on to the mother what she wants if she can not come here, which she can't. Now she has to regroup and her plan does not have to be your plan.

I already said she should not be let back in and STRIPPED of her U.S. citzenship. This is a better legal position that cannot be challenged in court and is clean and neat.

My focus is on an 18 month old child that should be STRIPPED from his mother. If there were U.S. citizen grandparents then they could apply for sponsorship and bring him in to protect the welfar of the child. It appears the grandparents are NOT U.S. citizens so not an issue.

Her father was a diplomat and was given diplomat status according to the State Department. Applicable immigration laws and treaties clearly specify that diplomats are not subject to jurisdiction of the U.S. within the meaning of the Constitution and this is settled law, and thus she was not born as an American citizen. I am not going to litigate the conclusion of the State Department here, and have no problem with her trying to make a case that he father was not a diplomat even though he was here under a diplomatic visa. If she can make her case, go for it.

But that is a different argument than saying that she is just a poor isis bitch with a son who is entitled to be here because the grandparents later went on to become naturalized citizens.

No doubt your lefty lawyer ilk will throw massive resources at her, because they have an immediate hard-on for anyone who hates the U.S and wants to come here. I refer to the mother here. If you have information that the child was born here I would have to hear that.

So how did she get a U.S. Passport then? Where in the Constitution is a non-citizen allowed to get a Passport?

Was she Not a citizen when she was issued a U.S. Passport or is not a citizen now?
