Yes, of course, the courts have been clear that there are circumstances could give rise to a revocation of citizenship but you still have to establish that the defendant intended that as part of their actions. Lots of people piss on the american flag or flee the country and say that they hate the country and everything in it but want to maintain the benefits of american citizenship or have not uttered words specifically affirming that intent.

What you raise is an issue for a jury to decide her intent and her stating what her intent was is not definitive on the issue because she is being charged with a crime basically.

All defendants will tell you their intent was not to hurt, kill, destroy etc.. but facts can be established to create a case. If the U.S. wants to strip her of her citizenship they can try but you overlook the most important point. there is no reason to even go down that road. They can simply deny her entry to the U.S. on national security and no citizenship trumps that.

Therefore the whole citizenship argument is a red herring...it never changes the facts even if she was one by birth. Citizenship does not trump laws and if you did some ISIS shit, you can be denied return or asylum as she claims with her ISIS baby. Sounds cruel but would be really hard for her to fight it unless she acepts she comes here and goes right to Guantanamo or a military base as a prisoner of war/enemy of the state.

You keep focusing on citizenship as though it is tattooed on your ass at birth but it can be revoked if the government really wants to and has a strong case. If the only evidence a defendent has is that it was not their intent, actions speak louder than words and she is fucked. U.S. owes her nothing anymore unless she wants to stay in prison for life. But her parents are not even citizens so again....moot.

What we learned from me is that a person CAN lose thier citizenship, you said they couldn't.

What I said is that an attorney can make the claim that ISIS mama renoucned her citizenship if she ever had it. it is up to her to prove untrue but simply claiming she had no intent is a bullshit argument only non-lawyers would fall for.

What I said is that a soldier's citizenship is irrelevant, he is owned by the military so they do not open a debate if his actions to go join Taliban is a rejection of his citizenship, they will own his ass no matter what so why even debate the issue. As I said..are there non-citizens in Guantanamo? Of course there are. Proves my point that in military cases there is no need to raise this issue or debate it, it plays no role whatsoever.

I quoted an article that said that the Brits had just flat out "stripped" some of the British Isis fighters of their citizenship and I said that I wished that we had that. We don't.

I argued that there is a more involved process in this country- beyond your assertion that certain actions were sufficient on their face- before a revocation of citizenship is acknowledged. The person must have done the reprehensible action and state that the intent of those actions was to revoke their citizenship. I am having to get repetitive here with you, but pissing on the American flag, burning a passport, defecting to another Army alone are not sufficient. Many people have done those things but still preferred to remain an American citizen for a variety of reasons, mostly convenience.

I have not read some of your posts where they get repetitive, but I asked you a couple times whether Beau Bird-dog is still an American citizen even though he has done the ultimate in defection and joining the enemy? Hope you have a better answer than you did the first time, by pointing out that he was a soldier. Ahh. That does not work. In reality, you cannot strip him of his citizenship if does not want to give it up. Unless there is a fact pattern that shows his intent and affirmations to that end. If there is, then there is, but that would not be a stripping him of his citizenship. It would be an acknowledgement of his choice beyond just some reprehensible actions.
