If the President Elect is Impeached who is sworn in?

Scenario: Comey panels a grand jury and charges are brought against Hillary, can she (if elected) be impeached before taking oath, and if so who becomes POTUS?

I think The AG has to do that,Comey is not a prosecutor.

I believe it's the court, not the prosecutor that summons a grand jury.

And I'm not sure in Federal matters but in our state there is always a grand jury that is in place with scheduled meetings, which can be called when needed. The Prosecutor takes their evidence before the GJ.

I'm no expert on this but I think someone has to bring it to the court and thats Attorney Generals office.I think The FBI refers the case and recommends prosecution to The AG,and The AG decides to prosecute or not.

Last time Loretta Lynch voluntarily said she would let Comey and other prosecutors decide,I don't think she had to nor do I think she would do it again.

I'm no expert on this stuff so if anybody is please correct me if I'm wrong.
 
If Comey says the new emails contain enough information to indict Hillary or Huma and need to be brought before a GJ, Lynch would be taking one for the team by refusing.

This isn't about politics as much as its CYA from the fallout, as the proverbial "cats out of the bag" and a shit storm is brewing.

Sorry, but Hillary's her own worst enemy. Her above the law attitude is finally about to catch up with her.
 
Impeached doesn't mean convicted. She could be acquitted. She would take office while impeachment proceeding occurred. Conviction would mean congress can remove her from office and the VP becomes the prez. The president also has the power to pardon themselves so even if convicted I do believe she could immediately pardon herself if in office, or Obama could do it if this happened before Jan 20, 2017, which would be highly unlikely things would move that fast. The pressure to resign would be immense, and she could do that for the good of the nation like Nixon did, but we're talking about a Clinton. The good of the nation isn't really relevant in their world.

Wouldn't a federal conviction, pardoned or not, disqualify her from office?

Unlike last time Lynch has an out for herself by calling Comey a partisan hack who tried to influence a Presidential election.She'd take some heat but Comeys reputation is damaged enough for her to do it.

That would required 2/3rds vote from The Senate,very unlikely imo.
