Wrong. You can certainly charge someone with obstruction of justice even if charges are not brought up in the investigation of a possible crime.

Regardless, I’m not sure it was you but there was a strategy floated here that Trump should just do the interview and plead the fifth throughout. That is probably the best advice.
What happens after that is totally up in the air.
ET being wonky, what was he obstructing if a crime didnt happen?
No, that would not be my advice exactly.
He should just not do the interview and assert Executive Privilege since it is known that mueller wants to question him about interactions with subordinates in regard to obstruction and collusion/ not a crime.
Mueller can then decide whether he wants to go the subpoena route or not and try out the same questions before the grand jury and can assert both executive privilege and the fifth depending on the nature of the subject of the question.
Guiliani is subject to spells of being ditzy and going off the record. Nevertheless, I think his basic strategy of resistance is a good one. Having said that, trumps triumphant rallies and his own ego continue to think make him think that he can go into any situation and command it so he has as a death wish that may prevail and he might show up. I think some good work has been done as far as limiting the scope of mueller's scope if such an interview does occur- but beyond that Trump has gotta do what he has gotta do. I would not recommend showing up at all, ever.
It is still very volatile though. Right now I think Trump is at risk of showing up. But if tomorrow, he begins to believe that Don Jr. or Jared are going to be indicted or attempted anyway, he can go full legal and dark at any moment. So Mueller needs to watch his arse too, along with Trump. He knows that not getting convictions on Trump or even an interview will be a full, full defeat- of which he has some notable ones on his resume already.
Good luck selling half the country on obstruction of justice when no crime took place, there will be civil war if Mueller tries to pull bullshit like that.
All of this is good stuff with the exception of your analysis of Mueller and what would be considered a defeat. There is no victory or defeat, only a complete and thorough investigation. That’s his job.
Mueller has been charged to get it right, prosecute the criminals and inform the American people of what went on during the 2016 election with regard to the Russians and Teumps campaign.
