I hate making decisions. Almost every decision I ever made has been wrong. That's why the creed I live by which has served me well in trading and in real life is, "If you wait long enough, someone will make up your mind for you."

What if the president (or incoming Republican president) were to exercise conservative values and declare... "No more nanny state. Generous government subsidies to be severely curtailed.... to become limited to "a cot in a shelter + meals in a soup kitchen line, nothing more. And if you want better than that in your life, GET A FARKIN' JOB AND PAY FOR IT YOURSELF!"

Would the 43% still want the president to be able to ignore the rule of law and the Constitution?

No, I'm pretty sure we would get the patronizing lectures about the need to obery the Law of the Land, even if it is made-up bogus constitutional "rights' invented by politicized judges.

But I have to say I am with the 43%. I don't think the President is automatically bound by whatever a court, even the Supreme Court says. The Executive Branch is a co-equal branch of government. It doesn't answer to the Supreme Court. Certainly, it is far better for the three Branches to play nicely together, but the drafters of the Constitution intentionally set them at odds with one another.

The Supreme Court ruled against President Bush on the terrorist detainees and other aspects of the fight against al qaeda. I think he would have been justified under the Constitution to ignore their rulings. The Executive Branch has exclusive power to wage war and to conduct foreign affairs.

Judicial activism has been a stealth war on our democracy. We have a variety of social policies and policies on things like welfare rights that have been forced on us as supposed constitutional rights. Voters would never have approved abortion or gay marriage in many states, yet centuries after the Constitution was ratified, we are told it suddenly requires those as constitutional rights.

A President can safely ignore the Judical Branch only if the Legislative Branch is willing to let it happen. Otherwise they can impeach him. Thus, the Drafters brilliantly gave us a check on an imperial judiciary, but it requires the democratic, ie elected, Branches to defend democracy. So far they have both been AWOL, obama because he agrees with the Court and the congress because they are cowards.
 
Well then, we need to expunge the president, the house of representatives, and the supreme court, then just have a senate (with term limits, of course).
I'd vote for it.

By that reasoning then, the two challenges to Odumbocare, in which the Supreme Court sided with Odumbo, were nothing more than spittin' in the wind, waste of time. Had the decisions gone the other way, what? Obama just says "tough titty" and goes on about his business the way he wants? Might as well disband Congress and the Supreme Court.

I always thought when the Supreme Court ruled something unconstitutional, that mean "you can't do that", not "go ahead an do it anyway if you want".
