And jury nullification means you cannot appeal just because you claim you got an unfair trial. You need an actual mistake of law or application of law to claim something on appeal to get a decision from the higher court to remand and order a retrial (I will give oyu a hint how often that happens).

You don't overturn a jury decision in criminal cases unless you have an actual cause for appeal (incorrect decision of judge on objection, prosecution mistake). Not because you claim the jury is biased due to high profile case.

It is not really double dipping if they sentence him to each crime... since 40 years is the maximum penalty on the highest charge and he is a 1st time offender....

I am guessing 15 - 20 years target minimum.....Judge might show leniency here.

Ok quiet down I answered your question. Pre trial motions address questions of unfair trial due to venue. Case closed.
 
Someone asked if they requested a change of venue. They did request a change of venue several days ago. It was denied.

He's facing 12.5 years according to the guidelines. They can ask for up to 40 years.

He'll sit in segregation the whole time, too. Inmates don't like cops, much less killer cops.

You won't do 40 years for 2nd degree murder, 25 years for 3rd degree murder, then 10 years for manslaughter, because the other two are part of crime 1. It would be different if he robbed a bank and killed somebody, because they are two unique events, robbery and murder. If you committed 2nd degree unintentional murder you pretty much committed 3rd degree murder and manslaughter as well on the same person.
