FBI doesn’t record interviews and voluntary witnesses not under criminal investigation don’t need to be put under oath. However, it is still a crime to lie to the fbi even if not under oath.
As to congress putting anyone under oath, that’s a joke. No one ever gets charged with lying to Congress. I think roger Clemens famously told congress he never used steroids.
Oh, I know that standard dismissal the Hillary bootlickers use, that it is still a crime to lie to the fbi. The official media matters script requires that that rap be circulated.
I am not going to get down into the weeds here but the fbi conducted itself in a way that allowed Clinton to conduct herself in a way that obviated the oath and audio transcript. The rules are different for defendants that have been indicted or are officially in custody where they will do an audio recording. That is why Hillary was allowed to negotiate a voluntary appearance.
By contrast you can be sure that they have audio on Mannafort and Flynn and a full written transcript rather than just a summary form that they did for Hillary, or were alleged to do with her, we don't know because it is one of the things they are refusing to release - and is being subpeoned.
That's fine. I don't want to replay that. Let's see the summary transcript or full written transcript for Hillary and call that progress. There is a subpoena out for it. My point will remain the same which is that the fbi purposely followed a scale downed approach that failed to record - even if by written notes- her exact words in a way that perjury could even be established or not established. I guess McCabe has to testify again tomorrow to the Senate. Good thing you assured me that there was no investigation going on there because there is no independent counsel. I am going to guess it feels differently to McCabe and the other four or five people lined up.
It would be a mistake to think that you can lie to congress without consequences just because technically congress does not prosecute. It can lead to the appointments of independent counsel or referrals to the justice department to initiate criminal investigations, as we know. Also it can limited peoples careers or appointments. I would suggest that the fbi types not lie to congress even though congress will not directly prosecute them for it. You can wake up with your own little "Mueller" just for you, who will prosecute.
