The United States government along with the SEC(securitites and exchange commission) won't let you daytrade stocks with only 5K. You can daytrade futures but not stocks. You have to hold your stocks for 3 or more days before they will allow you to sell.
Yes, you still have to follow the rules even if you don't use margin money.
