It sounds like it’s back to how one defines a lie. A dictionary definition should be sufficient, but intent many times is a factor. Intent is hard to prove. However, long established patterns of behaviour can be considered good evidence of an intent to deceive. Kind of like pissing in a hottub. One time, and no one may notice. As more piss is added, things start to stink and you know the hottub has been pissed in.
