WTF? State of California taking money out of my checking acct?

I closed my account yesterday, and the woman who closed it with me didn't even care. No customer service, no sympathy for the situation, nothing.

Fuck Bank of America.

Most of these banks do not giving a flying fuck if you close your account unless its crazy go nuts huge. I opened an account at fifth third on some sort of money give away, started getting telemarketer calls from them, so I closed it. Their service at my branch sucked eggs anyway. But they didn't even ask me why I was closing it or anything. It felt like they thought they were doing me a favor and I should just STFU and take it.

Omg ! I just recieved the same mail today on the withhold from CA Franchise Tax Board . Im wondering if you can give me the number of the lady whom you talk with or the number that you called so i can get my issue resolved as well. Thanks !

Kathy, could you provide the name of the financial institution that did this?

It wasn't crazy go nuts huge, but it was 6 figures. Either way, I don't care.

I now use 5/3 and love them. The local branch office in my neighborhood is awesome.

I think the big thing to remember is to never use a bank that has a physical presence or affiliation in aggressive states like CA. I may be wrong, but I believe the FTB or other agencies can't cross state lines and garnish an account in another state without getting a court order in that state...

Final update.

Finally got the letter from the tax authority detailing that it was their mistake, and the reversal in my BoA account. BoA still, however, would not reverse their $100 fee. They told me it was non-refundable, despite me telling them that the whole thing was a mistake, and providing proof. They didn't care.

Closed my Merryl Lynch account, my checking account, and will get rid of the credit card just as soon as I get the cash rebate in points (it's like $500 so I don't want to throw it away).

Fuck Bank of America.

Thank God I found your post. I was considering changing my accounts from Chase over to BoA. Appearances be damned - I just might do all my banking out of a Credit Union that my father put a few bucks into for me when I was a child.

As I said, I have never lived, worked, gone to school, or associated with the State of California in any way shape or form. I went to the website and found some more information - this is some income tax claim from 1994. I was living in New Jersey (with my parents) as I had just graduated college that year. I have no idea what I can show to prove any of that apart from a college diploma.

Shouldn't THEY have to show me some documentation they have from some company claiming I worked there??

As far as the bank goes, I am done with BoA. I will also close my investment account with Merryl Lynch and my credit card with them (BoA). I know the Credit Union I have here in Florida would never have done that.

As soon as it hits 7:30AM on the West Coast, I'll begin lambasting them, though I don't know what effect I'm going to have.

Merrill Lynch = terrible mess. Was a Broker there before the bac nightmare. Can't imagine what it would be like now.

Update.

I called the number listed for the California Franchise Tax Board. It said the next rep would be with me in 1.5 hours, or it could call me back. So I did the call back. Calls me back in an hour and a half. I wait for another 20 min. Finally some dope picks up the phone and gets my info. Says "That's not the address I have on this account" and hangs right up! WTF

So I googled around and found another number randomly. Called and the lady asked how I got this number. I told her the story and how I got hung up on. She tells me this number is for legislators who have tax issues they need resolution on. I told her I wasn't a legislator but explained my issue and she said she'd help me this once. Dug into the file, found that the name wasn't even my name. It was close, but also had a note that read something like "match with IRS SSN by name" and said that someone must have did a typo and got my SSN.

She stated she would resolve the issue and gave me her phone number directly for future reference, and said she'd fax over to the bank to put a delay on the hold note until she could resolve it internally.

She was wonderful.

I am still stunned how a simple error like that can cause someone to reach into your private bank account and just take money!

Grandparents lived through the first depression,* and went to their graves never trusting banks. I always thought it was strange for them to keep so much cash in a lockbox (not even a safe, lol), but now I understand their fears. Am on hold with Wells Fargo as we speak with a similar issue. $6500 I tried to transfer, and they screwed it up so badly, the receiver didn't get it, and I'm on my THIRD DAY of trying to get them to either send it, OR FUCKING GIVE IT BACK TO ME, meaning PUT IT BACK IN MY ACCOUNT, NOT wells fargo's money market account, sitting there earning them $!!!!!!!
Am going this afternoon to close three accounts there if this isn't fixed NOW! To say I understand, is an understatement. Your money was basically stolen. Mine has been held by an 800lb gorilla that won't have my accounts after today.
Do you know of any good ok florida banks that aren't too big?

If the credit union receives a levy order, it would not act any differently than BofA.

It's not just "someone," it's the tax collector. For obvious reasons the FTB is very aggressive, but all state tax agencies and the IRS have the legal authority to levy your account without due process. Most people are oblivious like you were before this happened.

Congratulations! You got your cherry popped. You are lucky it was just a small dick that got barely inserted by mistake.

Well, all I can say is California is beautiful, but they're Nazis when it comes to taxes, and I hope they choke themselves out completely as a result. Hell, Texas and Colorado has already stolen lol, so much CA industry, it's bind boggling. As for the IRS, can imagine they'd need police escorts if anyone even knew one of them was an IRS agent! IRS is PURE Gestapo, and our Founders would flip backwards knowing of their existence. Now just why did the serfs of the UK come here? On yeah, they were taxed too heavily, 10% of their money, or 10% of their crops, not to mention they were persecuted for their Christianity. Now just look at where we are now! Same place, but much, much worse.

Never mind. 5/3 sucks as well. Was their Investment "Executive," after leaving mother Merrill. Total nightmare! And what I saw them doing behind the scenes.
My now ex-father in law almost shot me when he found out I took that position, as both of his then college daughters fell into the 5/3 trap as well. And YES, 5/3 does hold transactions hoping one is enough to overdraw the account, so they can say cha Ching $33 x however many charges were made over that particular weekend. Yes, they should be in prison as we speak! Dirty bastards they are! Looks like I'm headed to a credit union right now.
My advice: if it's a big bank, run like your ass is on fire! And dirty 5/3 tried to separate themselves from the rest of the Charlotte banks by saying, "we're an Ohio bank." Well, whatever. They're still criminals..
