There is a tension between the Supremacy Clause and the Tenth amendment which withdrew a lot of subject matter from the federal govt.
Over time the court has eroded the 10th amendment but we know justices no longer seem to care about tradition, precedent and prior cases... freeing a future states rights activist court to wipe out the last 80 years of bad decisions and give back power to the States. Judicial activism is dangerous and cuts both ways.
