While the House was in session, fully controlled by the repubgniklans, the rules could have been changed...easily.

They could be changed right now if the fat azz lazy repubniklans gave a shit...they could suspend his pay, etc.

But they won't go after one of their "own" no matter how corrupt.

Why would Congress change a 220 year old rule over Bob Ney. Who is he? The SIXTIETH member of Congress in the past century to be convicted of a crime? The Democrat's almost failed to kick Adam Clayton Powell out AFTER hearings in 1967.


In January of 1967, following allegations that Powell had misappropriated Committee funds for his personal use and other corruption allegations, the House Democratic Caucus stripped Powell of his committee chairmanship. The full House refused to seat him until completion of an investigation by the Judiciary Committee. In March the House voted 307 to 116 to exclude him. Powell won the special election in April to fill the vacancy caused by his exclusion, but did not take his seat.

Powell sued in Powell v. McCormack to retain his seat. In June of 1969 the Supreme Court ruled that the House had acted unconstitutionally when it excluded Powell, a duly elected member, and he returned to the House, but without his seniority. Again his absenteeism was increasingly noted.

In June of 1970 he was defeated in the Democratic primary by Charles B. Rangel, who has represented the area ever since. Powell failed to get on the ballot for the November election as an independent. He resigned as minister at the Abyssinian Baptist Church and moved to Bimini. In April of 1972 he became gravely ill and was flown to a Miami hospital. He died there on April 4, at the age of 63. A few days later his ashes were carried aloft by a plane and scattered over his beloved Bimini.

What crime was Powell charged with by the authorities that he admitted guilt to, as a result was subsequently convicted and was bound for prison?

We are talking about a convicted FELON in Ney, a member of the "party of FAMILY VALUES" not someone who may or may not have been found guilty in a court of law....

Hell, there are lots of jobs that a convicted felon can't hold...but we can allow a Congressman to keep working when convicted of a felony, especially one that involves such a high level of moral corruption?

WASHINGTON — Even though he voted four months ago to deny pension benefits to members of Congress convicted of a felony relating to their official duties, Rep. Bob Ney will be eligible to receive his congressional pension after he serves his prison sentence.

Ney, R-Heath, has agreed to plead guilty to federal charges that he accepted free trips, meals and drinks from now-disgraced lobbyist Jack Abramoff, and gambling chips worth thousands of dollars from a Syrian businessman.

Next month, a federal judge is expected to sentence him to as many as 27 months in prison. However, Ney, 52, will collect his pension because the Senate and House could not agree on a sweeping package of lobbying and ethics reforms.

The House version approved in May would have prohibited lawmakers convicted of a felony relating to their official duties from receiving their pensions, but House and Senate negotiators have not agreed on a final version of the bill.

When the House approved its bill, Ney issued a news release saying he was "proud to help" pass the measure. The release noted he had insisted that the final version of the bill require that any member convicted of bribery or extortion lose their federal pension.

Mary Jo Kilroy, the Democratic challenger to Rep. Deborah Pryce, R-Upper Arlington, called on Congress to "strip Ney of his federal pension so that taxpayers are not left funding a felon's future. That money should be donated to the U.S. Treasury to pay down the federal deficit."

But Melanie Sloan, executive director of Citizens for Responsibility and Ethics in Washington, said there is little chance that Congress would swiftly move to revoke the pension of a member convicted of a crime.

"It's really pretty outrageous," Sloan said. "They are committing crimes involved with their office and they still get their pensions. The tax dollars shouldn't be used to pay the pensions of crooked members of Congress."

Although a member of Congress can collect a pension worth as much as 80 percent of his or her $165,000 congressional salary, it is doubtful that Ney's pension would be that lucrative. Ney has served 12 years in the House and cannot even begin to collect his pension until he reaches age 56 in 2010. And if he begins collecting his pension before age 62, he would receive a reduced amount of money.
