Actually the ACLU never stated that they have sued this guy in the ACLU press release. Let's take a more in-depth look at what the ACLU website in Kansas says. Why yes, they did sue the guy four times...

This nifty chart shows that all four suits are ongoing (not successful as some would claim) as per the Next Move column. All are going to the next round in court. All the ACLU got was a temporary injunction while the suit moves to full trial. Hard to call this a success (unless you are twisted as the ACLU). Just because you brought the case before the one Democratic judge in the state to achieve an injunction still makes it unlikely that you will win in a full trial with a panel of Republican judges.
