Obviously, it was out so the guy who saw it could get alarmed. If it was hidden and concealed, he wouldn't have seen it, right?

It is a violation of CCW law to have your gun out so the public can see it. If you want to transfer the weapon from your car to your IWB holster, then you do it in the confines of your car, not out in the open.

So yes, it sounds as if it was a technical violation of the law - but regardless, it doesn't forgive the other guy jumping him.
 
Yes. If you have a CCW, you must keep it concealed. You cannot draw it.

Some Super Glue will help in case you forget.

Ignorance of CCW law all over this post. You draw your weapon when you are going to use it. If you display it in any way outside of that (in public), you could be liable for brandishing a firearm (state law dependent).

OTOH, if he'd felt threatened by the attacker, he could have shot him under the SYG law (Florida, remember). Of course, this would also involve a black guy shooting a white guy, so he probably would have been tried, convicted, and executed. Being Florida and all.
