Ok how about this for a scenario...lets say you get in a car accident and go to the hospital. Your brainwave activity stops, but the doctors have invented a machine that can start your brainwave activity again, wake you up, and you can start living your normal life. This machine takes several months to get your brainwaves working again though. One day your wife decides this hospital bill is going to be expensive once you come around again and she doesnt want the burden of paying for it and she stabs you in the heart. Should she go to jail or should nothing happen to her? After all, your brainwaves had stopped and they wouldnt start again for months, just like a fetus.

I don't speculate on the ridiculous as an excuse to ignore the reality. Your what-if scenario has nothing to do with the reality of fetal development. At some point an acorn stops being an acorn and becomes an oak tree, but that point is clearly not at the moment the acorn falls from its parent tree.
