do they get released? if so, when and on what terms? how are they treated differently? what if you capture people and they just keep on coming after you after you release them??

It depends on the side that captures them
If Iraqis capture ours, they treat their injuries and let them go
If we capture theirs, we beat the carp out of them, kill them and call it war
