While there may be peaceful protesters out past curfew, that still doesn't make them violent protesters. So the question still remains:
Where is your evidence that people crossed the border to participate in violent [corrected typo] protests, as required for the statute/regulation/etc. to apply?

There is also a lot of video -- which is much better than witnesses.
I expect the video will be used by defense lawyers as a basis of a "self defense" plea to avoid criminal liability.
It is also an open question if the Wisconsin DA will directly pursue the case --- most likely they plan to put it to a grand jury indictment rather than commencing a felony prosecution directly.
Fact1: we know the shooter drove from one state to another
Fact2: we know at least one of the victims is from Wisconsin.
Speculation 1: we believe people drove across state lines to participate in the protests
Speculation 2: we could assume some of those that drove across state lines participated in rioting and looting

During a Wednesday news conference, Kenosha Police Chief Daniel Miskinis said the shooting may not have happened if demonstrators and the accused gunman had obeyed the city's newly imposed 8 p.m. curfew.
"Everybody involved was out after the curfew," Miskinis said. "I'm not gonna make a great deal of it but the point is -- the curfew's in place to protect. Had persons not been out involved in violation of that, perhaps the situation that unfolded would not have happened."

Which is worse, breaking curfew; or unlawfully bringing an AR to a heated protest after posting to social media that you "just want to become famous?"
