In a 36-page ruling in July that dismissed all of Sandmann's claims based on his initial complaint, Judge Bertelsman said that The Post never mentioned Sandmann by name in its initial coverage of the incident, referring only to groups of "hat-wearing teens." The judge maintained that "the words used contain no reflection upon any particular individual" and thus could not be constituted as defamation.

Thirty other statements reported by The Post that Sandmann alleged to have been defamatory are not covered by the reconsidered ruling, and they remained dismissed.



Far from a win

But, Judge Bertelsman said in his new ruling, discovery should be undertaken concerning the "context" of the claims that Sandmann had blocked Phillipps. After discovery, the judge could make a summary-judgment ruling -- or send the case to trial.

I guess he only needed 3.

Nick Sandmann’s Lawyers Say They’ll Sue 5 Additional Media Companies

Covington Catholic student Nick Sandmann will file lawsuits against five more media outlets regarding a viral incident that took place at the March for Life event in 2019.

His attorneys filed a status report with the U.S. District Court in Covington, stating that they are looking to file complaints against ABC, CBS, The New York Times, Rolling Stone, and newspaper operator Gannett before March 9, according to local media reports.

Boys in ‘Make America Great Again’ Hats Mob Native Elder at Indigenous Peoples March

“I heard them saying ‘Build that wall! Build that wall!’” the Native elder, Nathan Phillips, said. “This is indigenous land. We’re not supposed to have walls here.” The episode, which gained extensive attention on social media, was widely condemned.
They were Catholic high school students who came to Washington on a field trip to rally at the March for Life.

He was a Native American veteran of the Vietnam War who was there to raise awareness at the Indigenous Peoples March.

They intersected on Friday in an unsettling encounter outside the Lincoln Memorial — a throng of cheering and jeering high school boys, predominantly white and wearing “Make America Great Again” gear, surrounding a Native American elder.

The episode was being investigated and the students could face punishment, up to and including expulsion, their school said in a statement on Saturday afternoon.
