The bar is lower in civil trials but not on the floor....there is zero proof of rape and trump is most likely not compelled to turn over his DNA in a civil trial. This is an event that happened 27 years ago with no witnesses. You can wish trump gets hit by 4 trucks in a row but you cant fabricate a judgement based on no evidence whatsoever even in a defamation trial.
If she cannot prove a rape happened that trump is allowed to deny a rape happened in the media. case dismissed.
yeah, I'm with you.. So Trump denied having sex w/her, so what? Guy's a prolific liar. If some woman w/next morning regret's saying rape (not that this is what happened at all) comes after a guy years later, I can't fault the guy for denying even knowing her just to spite her. Trump denying sexual relations may as well just be a malicious dig (just like the "not my type" comment). Basically another variation of "never knew the guy, just a coffee boy". This case is a tall order, short of having another witness in the room (like Blasey Ford did and GOP disallowed producing such witness), it's a he said/she said case.
Though I am curious what DNA evidence she saved. Maybe she gave him another ball spot.

You're being obtuse. It's "he said, she said" but with the potential added twist of DNA. If he didn't deny having sex with her, then it would be murkier. But his having denied ever having contact with her, and then there being DNA evidence? Those dots are practically Lego pieces that attach in a civil case.
I don't think it will be regarded quite as benignly in a civil suit. But it'll be fun to watch as it plays out.
Not being obtuse just analyzing the law.... she is suing him for defamation....you cannot sue because someone denied having sex with you. the heart of her defamation is that she was raped and he said bad things about her claim. If she cannot prove she was raped, then how can she prove she was defamed.
You are allowed to criticize people and say they are going after you for money or political attack and deny a rape. That is not defamation if no rape was proven (stormy daniels any one?).
There is no DNA evidence because all she has is some claim to DNA and trump is under no obligation to prove her case... a jury cannot find defamation on a fact that is not proven to be true. there is no wiggle room on that in defamation cases.
Even if she has DNA from bodily fluids?! Whatever. My popcorn is at the ready. Let's see what happens.

The amusing part is that she claims that Trump's DNA semen is on her dress from when he raped her in a changing room -- and she kept the dress all of these years. Didn't Bill Clinton provide a lesson about leaving DNA on a dress?
DNA from body fluids could establish they had sexual relations. A sitting president denying having sexual relations with a woman does not give raise to monetary damages in a defamation lawsuit.
As with all rape cases, showing they had sex in 1996 does not mean she was raped and a person can deny allegations in the media if they are a public person.
I dont understand that she is raped in 1996 and does not want to report it to the authorities or go after him but she saves a dress from almost 30 years ago that was never washed or cleaned and is sitting in her closet all those years with what.... a money shot stain?
