I'll have to take your word for it, but still the police was justified. Fighting an officer and resisting arrest while you have SOMETHING that looks like a small weapon in your hand is not the best idea.

If the cop had shot him while they were fighting I would agree but the fight was over,the cop had backed away and the suspect was just standing making no aggressive moves when the cop shot him.If the suspect had shot the cop in those exact same circumstances he would be charged and convicted of murdering a cop.

When a cop sees a gun they have to back off and gain some distance before shooting. You don't want to pull your gun at close range as it can easily be knocked around and you end up shooting yourself.
