How is it possible for anyone, such as yourself, to get things so upside down? No conviction of sedition is required to be ineligible to run for Federal Office under the 14th Amendment. Few, if any, of the Southern Confederate insurrectionists made ineligible by the 14th Amendment to run for Federal Office in post Civil War America were ever convicted of seditious conspiracy. Their "participation" in an insurrection was sufficient to disqualify them. Thus there is a strong legal precedent that Trump must overcome. Trump, like those declared ineligible before him, is a non-convicted insurrection participant. The Colorado Courts reading of the Amendment is very much an originalist's reading --- one to make Scalia grin from ear to ear in his grave. There are several members of the current High Court who identify with "originalism".In order to say a his actions were criminal you need a conviction. Innocent until proven guilty.
No one, not Trump and not any of the Jan 6 rioters has been charged, much less convicted, of "insurrection".
I really hope Trump isn't the nominee but this ruling looks like something out of a banana republic.
