The seller should state that its a copy this in the listing, otherwise the buyer will have a genuine gripe as they are probably expecting the original.

If it is a copy then it a counterfeit of the orginal and is a viloation of the e-bay TOS, regardless of any copyright violation.

I assume by your last that Mr. Glyn no longer holds the copyright. I have no idea if that is the case, but your auction omits any reference to provenance.
