But Kennedy (the expected swing vote) while asking though questions to the government about their position seemed to throw them a bone at the end saying something like this may be an occasion where the issue is unique enough that Congress should be given broad latitude.
I hope that is all it was - throwing them a bone to give them a couple months of false hope.
