as stated in the thread you're referring to, i had like 10 beers that night and it was like 3am. i fully admit that post is one of my worst.

Just goes to a show that a 3.9 GPA doesnt mean SQUAT
when it comes to common sense :D

The court should simply decide wether or not this 15 year
old has the capacity to make adult decisions, and if so,
if this was consensual, he should be let free.

If a group of experts decides THIS 15 year old, does not have
the intellectual capacity to pass as an "adult", then he is screwed.

The extreme analogy which points out the core of this issue is this:

Say a 50 year old had sex with a 5 year old. And the 5 year
old said she enjoyed it and WANTED it. Clearly...it doesnt matter
what the 5 year old says because the 5 year old is NOT an
"intellecutal adult" who can make those kinds of decisions.

This 15 year old girl, may in fact, have the "adult reasoning faculty" to
make such decisions, but unfortunately, "the law" has to draw
a line in the sand somewhere.

This guy wasnt too bright for crossing that line.

There you go applying your erroneous logic to law. The law states very clearly at what age one is considered an adult. Now, if you are below that age, you are not a legal adult. If you are that age or above, you are an adult. Pretty simple math, isn't it?

Now, if you want to debate "subjective maturity," then I could argue that there are a lot of 15 year olds who are more mature and adult-like than some 40 year olds.

You want a panel of experts to decide if this girl can make "adult decisions?" Give me a break. She already made an adult decision when she decided to have sex with him. What you are asking is to put together a panel of experts to decide whether she made the "right decision for her age." Obviously she wanted to have sex with him -- it was not rape in the non-statutory sense.

This is a cut and dry case. Putting this man in jail for 10 years doesn't help him or society, so it is a stupid decision. You don't need a panel of experts to see that, just common sense.

The only thing simple is your mind. How do you think the
LAW MAKERS came up with this arbitrary line? Ever think about that?
They took an educated GUESS. Clearly not ALL 15 year olds
are adults. And clearly not ALL 15 year olds are children.

Is this guy a sexual predator. Is there any evidence of that?
