A bogus prosecution by the government is dangerous. The prosecutors know that they will not not win the case. Their objective is to punish Exxon financially for free speech. As a side note, George Will probably should have used "almost always" instead of "always".
I'm not following on how this failed effort will punish Exxon for free speech. There is obviously something I don't know. What is it?

That's dumb, George. Authoritarianism is a key method of conservatism, because conservatism doesn't want things to change, or at least it wants them to change slowly. That requires just as much control as the forcing of change would.
